SC questions 'haste' in appointment of Arun Goel as Election Commissioner

New Delhi:The Supreme Court on Thursday questioned the "haste" and "tearing hurry" in appointing Arun Goel as Election Commissioner. The Centre vehemently resisted the observations, with the attorney general asking the court to "hold its mouth" for a while and look into the issue in entirety. At the outset, a five-judge Constitution bench headed by Justice K M Joseph perused the Centre's original file pertaining to Goel's appointment as EC, and said, "What kind of evaluation is this? Although, we are not questioning the merits of Arun Goel's credentials but the process." As the bench questioned the "lightning speed" with which Goel was appointed as an EC and also that his file did not even move within departments for 24 hours, the Centre through Attorney General R Venkataramani vehemently urged the bench not to make observations without looking into the entire issue pertaining to the appointment process. "Please hold your mouth for a while. I request to look into the issue in entirety," the top-most law officer told the bench. Justice Ajay Rastogi, who is also a part of the bench, told Venkataramani, "You have to listen to the court carefully and answer the questions. We are not on individual candidates but on the process." The attorney general said he is bound to answer the questions of the court. ANI New Delhi, November 21 Former bureaucrat Arun Goel assumed charge as the new Election Commissioner of India on Monday. Goel, a former IAS officer of the Punjab cadre, was on Saturday appointed as the Election Commissioner. Arun Goel. ANI The Minister of Law and Justice on Saturday notified the appointment made by President Droupadi Murmu. "The President is pleased to appoint Arun Goel, IAS (Retd.) (PB: 1985) as the Election Commissioner in the Election Commission with effect from the date he assumes the office," it said. Goel had on Friday taken voluntary retirement from the post of Secretary, Heavy Industries. He will join Chief Election Commissioner Rajiv Kumar and Election Commissioner Anup Chandra Pandey in the Election Commission. Sushil Chandra retired as Chief Election Commissioner in May this year. Arun Goel assumes charge as Election Commissioner

Arun Goel, a retired IAS officer of the 1985 Punjab cadre, assumed charge as the new Election Commissioner (EC) of India here on Monday. Chief Election Commissioner Rajiv Kumar, who is currently in Nepal as the international observer for their ongoing national elections, personally called and congratulated Mr. Goel on his appointment. With Mr. Goel assuming charge, the third and final vacancy in the Election Commission of India (ECI), which had remained unfilled since Mr. Kumar was elevated to the position of CEC, has been filled. Welcoming him to the Election Commission, Mr. Kumar said that his vast and diverse administrative experience will further strengthen the Commission’s endeavours in ensuring that the electoral process is more inclusive, accessible and participative. A Post Graduate in Development Economics from Churchill College, University of Cambridge, England, Mr. Goel started his career as District Election Officer/Collector in Punjab’s Bhatinda in 1993. Over the years, he served as Joint Secretary in the Ministry of Urban Development, Vice Chairman of the Delhi Development Authority and Culture Secretary, among others before retiring as Secretary from the Ministry of Heavy Industries recently.

The Supreme Court on Monday disagreed with the contention of NGO Association for Democratic Reforms that Election Commissioner Arun Goel will be a “yes man” for the government merely because the latter chose him. The bench presided by Justice K M Joseph subsequently adjourned the hearing after Justice Joseph recused from hearing it. “The point is after the appointment, it is a constitutional office. The person must act independently, fairly, justly. That’s a different aspect. Now you cannot say because this person has been appointed, he will not act fairly, justly, he is going to be a yes man, therefore set aside his appointment,” Justice B V Nagarathna, who was part of the two-judge bench that heard the NGO’s plea challenging Goel’s appointment, said. The judge made the remarks as Advocate Prashant Bhushan appearing for ADR sought to draw a comparison between Goel’s case and the appointment of P J Thomas as Chief Vigilance Commissioner by the erstwhile UPA government. To a query from Justice Nagarathna as to what rule was violated in the appointment of Goel, Bhushan contended that what had been given a goby were the rules of institutional integrity which the SC laid down in the case of Thomas. “The rule of institutional integrity has been violated. In this very case, the court had laid down what is the principle of institutional integrity here,” he told the bench. New Delhi, Nov 19 (PTI) Arun Goel, a 1985 batch IAS officer of the Punjab cadre who took voluntary retirement from Friday, has been appointed as an Election Commissioner. He was to retire on December 31, 2022 after completing 60 years of age. Once he joins his new responsibility, Goel would be in line to be the next chief election commissioner after incumbent Rajiv Kumar demits office in February 2025. He will join CEC Kumar and Election Commissioner Anup Chandra Pandey on the poll panel. There was a vacancy in the EC following the retirement of Sushil Chandra as CEC in May this year. Goel was, till recently, the heavy industries secretary and his voluntary retirement came into effect on November 18. He has also served in the Union Culture ministry. According to the law dealing with appointment, service conditions and retirement of election commissioners, a person can hold the office of an EC or CEC for six years or till attaining the age of 65, whichever is earlier. Goel will be in office till December 2027. “The President is pleased to appoint Shri Arun Goel, IAS (Retd.) (PB: 1985) as the Election Commissioner in the Election Commission with effect from the date he assumes the office,” the law ministry said in a statement on Saturday.
