GCC warns of action over non

CHENNAI: The Greater Chennai Corporation has warned of strict action, including sealing of property, against owners who fail to pay the tax. According to a report from Maalai Malar, the civic body said that penalty will be imposed and strict action will be taken on non-payment of property tax and professional tax within this month. Officials added that properties of owners who fail to explain the follow-up notice would be sealed. With revised property tax rates put in place, the Greater Chennai Corporation is expected to generate annual revenue of Rs 1,200 crore from the 12 lakh property owners within its limit. As the first half of the year is completed, a revenue of Rs 700 crore is to be collected. However, officials claim that only Rs 490 crore has been collected so far. Apart from the new property tax implementation, notices have also been sent to the owners to pay the outstanding property tax.

Interim stay on property tax revision

CHENNAI: Stating that there was no clarity on the computation used to arrive at the revision in property tax that the Greater Chennai Corporation had announced recently, the Madras High Court imposed an interim stay on the enhancement and directed the civic body to file a counter explaining how the revised tax amount was arrived at. Justice Anita Sumanth issued the direction while hearing a petition filed by K Balasubramaniam of Teynampet, who sought a direction to quash the property tax revision notice for the year 2022-23 that the Corporation served him on June 28. According to the petitioner, the half-yearly tax for his property for the second half of 2022-23 is fixed at Rs 7,170 as against the existing tax of Rs 3,695. This was against Section 100 of the Chennai City Municipal Corporation Act, 1919, he contended. Though city Corporation’s standing counsel Vaitheeswari submitted a resolution adopted by the Corporation Council to increase property tax, the court was not impressed. “The impugned order merely enhances half yearly tax from an amount of Rs 3,695 to Rs 7,170 and there is absolutely no clarity on the changed mode of assessment. The standing counsel is also unable to throw any light on the method of computation,” the judge pointed out. The Greater Chennai Corporation has requested property tax assessees to pay before October 15 and get a 5% incentive. According to a press release, people can pay the property tax on the Corporation’s website www.chennaicorporation.gov.in, at e-seva counters at zonal and divisional Corporation offices, through hand-held devices of tax collectors, on Namma Chennai and Paytm mobile applications, at select banks and through the Bharat Bill Payment System. During the first half-year of the financial year 2021-22, the civic body has collected a sum of ₹375.59 crore as property tax. A total of ₹225.13 crore of professional tax was collected during the same period. As per the amendment to the Chennai City Municipal Corporation Act, 1919, assessees who pay during the second half-year of 2021-22 before October 15, will be given 5% incentive up to a maximum limit of ₹5,000. Payments made after October 15 will attract 2% simple interest per annum. During the previous half year of April 2021, a total of 1.16 lakh assessees received incentive. CHENNAI: The decision was taken earlier this month, senior officials confirmed. There are around 1,739 cellphone towers in the city. “We will be putting out a public notice inviting comments from residents. Later, a formula will be devised to decide how much tax will be levied. It will be a function of the fee paid by mobile phone towers to property owners. We will base it on agreements signed between those parties,” an official said. The issue has been entangled in a legal dispute since 2009 when the civic body first proposed this tax. Just seven residents from T Nagar owed Rs 3.45 lakh in taxes, revealed civic body’s records as of last year. Initially, The corporation devised a tax formula which was the monthly rent multiplied by 10.92% and 12.4%. Later this was changed to a fixed amount of Rs 15,000 for every half-year. Property owners challenged this in the Madras high court, which in its April 2021 order asked the civic body to redetermine property tax and also asked the owners to submit relevant documents to the civic body.
