Krishna Janmabhoomi case: HC gives last chance to file reply in plea seeking transfer of suit

The Allahabad High Court on Tuesday gave last chance to all the respondents to file their replies by April 7 in a petition seeking transfer of Sri Krishna Janambhoomi case pending before a Mathura court to the high court. In the case, Hindu devotees have claimed right over the land on which Shahi Idgah mosque is built. The court directed the respondents — Management Committee of the Shahi Masjid Idgah next to Krishna Janmabhoomi temple, Shree Krishna Janmabhoomi Trust, Katra Keshav Dev, Deeg Gate, Mathura and Shri Krishna Janma Sthan Sewa Sansthan, Katra Keshav Dev, Deeg Gate, Mathura to file their respective replies through e-mode by April 7. The court also directed the petitioners to file their rejoinder affidavits after receipt of counter affidavits through e-mode and fixed April 11, 2023, as the next date of hearing in the case. Hearing a transfer petition filed by Bhagwan Shrikrishna Virajman at Katra Keshav Dev Khewat Mathura (deity) through Ranjana Agnihotri and seven others, Justice Arvind Kumar Mishra observed, "Considering the facts and circumstances of the case, particularly the interest of justice, no more time but last chance is given by 7th of April, 2023." On March 15, the high court had asked all the respondents in this case to file their respective replies in 10 days. AGRA Overturning its previous order, the court of civil judge senior division (fast track court) on Wednesday stayed the survey of the Shahi Eidgah Mosque premises in Mathura. The latest decision comes after the Sunni Central Waqf Board filed its objection in the Sri Krishna Janmabhoomi case. The court has now fixed April 11 as the next date of hearing. (HT File) Last year, the court, during the hearing of the case filed by Hindu Sena office bearers, had ordered for the survey of premises of the Shahi Eidgah Mosque. The survey was to be conducted by the court ameen (a staffer), who was asked to visit Shahi Eidgah premises and prepare a report. However, the order to conduct a survey was objected by the management committees of the Shahi Eidgah Mosque and Uttar Pradesh Sunni Central Waqf Board. After the big win for the Hindu side in the Mathura District Court, one of the petitioners, Advocate Ranjana Agnihotri, spoke exclusively to Republic TV and broke down the details of the Shri Krishna Janmabhoomi-Shahi Idgah Mosque dispute. Agnihotri explained that the Hindu side had moved the Mathura District Court to challenge a 2020 order, wherein a civil judge had dismissed their suit in the case on grounds that it is 'not maintainable' under the Places of Worship Act, 1991. "On September 25, 2020, a suit was filed in the Mathura court for Shri Krishna Janmabhoomi, but the court rejected it saying that if we will accept the case, petitioners will line up and we won't be able to handle them. We challenged the order in the district court and they accepted it. We want to thank Shankar Jain for this success. Be it Kashi, or Mathura, he has guided us," said Agnihotri. Suit to remove Shahi Idgah Masjid 'maintainable': Mathura Court On Thursday, the Mathura District Court ruled that the civil court's refusal to admit the Hindu side's suit on grounds of the Places of Worship Act, 1991, was incorrect. The revision plea was filed by Ranjana Agnihotri and others, claiming that 13.37 acres of land belonged to Hindu deity Lord Shrikrishna Virajman. It had asserted that as devotees of Lord Krishna, the petitioners had the right to move the suit in view of their fundamental rights under Article 25 (Freedom of Religion) of the Constitution.

Mathura: Presenting arguments on the maintainability of a suit filed over the Krishna Janmabhoomi-Shahi Idgah dispute, the defence counsel for the Uttar Pradesh Sunni Central Waqf Board told the civil judge's court here on Thursday that it is not maintainable as a compromise was arrived at in 1968. According to District Government Counsel Sanjai Gaur, defence counsel G P Nigam also told the court that "the compromise between the two parties cannot be challenged through a new suit in accordance with law and the parties can only appeal against the compromise and that too, within the stipulated time limit of three months". Civil Judge (Senior Division) Ruchi Tewari posted the matter to July 12 for further hearing. Supreme Court lawyer Hari Shankar Jain, a petitioner in one of the suits, was also present in the court on Thursday. Hari Shankar Jain suggested to the court to club all the suits as the decision of their maintainability will be binding on every party.
