The tussle between the Shiv Sena leadership and rebels MLAs, which threatens to bring down the Maharashtra government, moved from the hotel to the courtroom today. Acting on Eknath Shinde's petition challenging the disqualification notices issued to him and 15 other rebel MLAs last week, the Supreme Court issued notices to Deputy Speaker Narhari Zirwal, Chief Whip Sunil Prabhu, leader of Legislature party Anil Chaudhary and the Centre. The top court will now hear the matter on July 11. Eknath Shinde, who leads the rebellion, had challenged the Uddhav Thackeray leadership's move to disqualify him and 15 other MLAs in the Supreme Court. New Delhi: The Supreme Court today said that the Maharashtra Governor was not justified in calling upon then Chief Minister Uddhav Thackeray to prove majority in the Assembly on June 30 last year but refused to order status quo ante, saying he did not face the floor test and resigned. In a unanimous verdict on a batch of pleas related to the political crisis that led to the fall of the Maha Vikas Aghadi (MVA) government led by Uddhav Thackeray following a revolt by the Eknath Shinde faction, a five-judge Constitution bench headed by Chief Justice DY Chandrachud held that House speaker's decision to appoint Bharat Gogawale of the Shinde faction as the whip of Shiv Sena was "illegal". It, however, said since Mr Thackeray had resigned without facing the floor test, the governor was justified in inviting Mr Shinde to form government at the behest of the BJP which was the largest political party in the house. By Kanu Sarda: A Constitution bench of the Supreme Court on Thursday reserved its verdict on a batch of petitions filed in connection with the 2022 Maharashtra political crisis. The crisis was triggered by the breakaway Shiv Sena faction-led by Eknath Shinde, leading to the fall of the Uddhav Thackeray-led Maha Vikas Aghadi government and the division of Shiv Sena. A five-judge bench headed by Chief Justice of India DY Chandrachud and comprising Justices M R Shah, Krishna Murari, Hima Kohli and PS Narasimha was hearing the clutch of petitions. Sibal further argued that the dissent was outside the House, not inside the House. "The Governor's acts placed a premium on the unconstitutional acts of the faction, allowing them to topple the government. He knows. He went outside the scheme of the 10th Schedule," Sibal argued. To this, the CJI said, "There's a split which is not recognised. But there's a group of legislators who say they withdrew support. They will incur a disqualification.
