World Report 2021: India

The Bharatiya Janata Party (BJP)-led government increasingly harassed, arrested, and prosecuted rights defenders, activists, journalists, students, academics, and others critical of the government or its policies. The government continued to impose harsh and discriminatory restrictions on Muslim-majority areas in Jammu and Kashmir since revoking the state’s constitutional status in August 2019 and splitting it into two federally governed territories. Attacks continued against minorities, especially Muslims, even as authorities failed to take action against BJP leaders who vilified Muslims and BJP supporters who engaged in violence. The Covid-19 lockdown disproportionately hurt marginalized communities due to loss of livelihoods and lack of food, shelter, health care, and other basic needs. Jammu and Kashmir Hundreds of people remained detained without charge in Jammu and Kashmir under the draconian Public Safety Act, which permits detention without trial for up to two years. In June, the government announced a new media policy in Jammu and Kashmir that empowers the authorities to decide what is “fake news, plagiarism and unethical or anti-national activities” and to take punitive action against media outlets, journalists, and editors. The policy contains vague and overbroad provisions that are open to abuse and could unnecessarily restrict and penalize legally protected speech. The government also clamped down on critics, journalists, and human rights activists. The restri...

India’s Muslims: An Increasingly Marginalized Population

• Some two hundred million Muslims live in India, making up the predominantly Hindu country’s largest minority group. • For decades, Muslim communities have faced discrimination in employment and education and encountered barriers to achieving wealth and political power. They are disproportionately the victims of communal violence. • Prime Minister Narendra Modi and the ruling party have moved to limit Muslims’ rights, particularly through the Citizenship Amendment Act, which allows fast-tracked citizenship for non-Muslim migrants from nearby countries. Experts say anti-Muslim sentiments have heightened under the leadership of Prime Minister Narendra Modi and the ruling Bharatiya Janata Party (BJP), which has pursued a Hindu nationalist agenda since elected to power in 2014. Since Modi’s reelection in 2019, the government has pushed controversial policies that critics say explicitly ignore Muslims’ rights and are intended to disenfranchise millions of Muslims. Under Modi, violence against Muslims has become more common. The moves have sparked protests in India and drawn international condemnation. Who makes up India’s Muslim population? Explained: When can states declare Hindus as minority?

Hindus can get minority status in some states: Centre to Supreme Court The Centre has told the Supreme Court that states can consider granting Hindus the ‘minority’ status, if the community is not in a majority within their jurisdictions, to enable them establish and administer educational institutions of their choice, in keeping with the rights guaranteed to But what does minority status mean, who decides it and why the "majority" is seeking the minority tag. Here's what you need to know ... Minorities in India The Centre had in 2013 said that the Constitution does not define the term “minorities” anywhere but only mentions it in some Articles. It had said that Article 29 refers to “minorities” in its marginal heading and speaks of “any section of citizens having a distinct language, script and culture”. An entire community or a group within a majority community could thus be seen as a minority. Meanwhile, Article 30 of the Indian Constitution states the right of minorities to establish and administer their educational institutions. It says: “All minorities, whether based on religion or language, shall have the right to establish and administer educational institutions of their choice.” But the Centre has stressed that such benefits do not involve quotas in jobs and admissions but efforts to raise the education level and participation in employment, skill and entrepreneurship development and reducing deficiencies in civic amenities and infrastructure. Moreover, these are ...
