The Ministry of Environment, Forest, and Climate Change announced the Plastic Waste Management (Amendment) Rules, 2022, which notified the instructions on Extended Producer Responsibility (EPR) for plastic packaging. On 6-07-2022 the Ministry of Environment, Forest and Climate Change further amended the Plastics Waste Management Rules, 2016 by adding a second amendment named Plastic Waste Management (Second Amendment) Rules, 2022. The Rules have added some new definitions, such as, biodegradable plastics, end of life disposal, plastic packaging, Plastic Waste Processors, pre-consumer plastic packaging waste, post-consumer plastic packaging waste, recyclers, waste to energy etc. Key modifications: S. No. Rule/Sub-Rule 2016 2022 1. Rule-9 Responsibility of producers, importers and brand owners Sub-Rule (1) To work out modalities for waste collection system based on Extended Producers Responsibility and involve State Urban Development Departments through their own distribution channel or through the local body concerned, within 6 months from publication Shall fulfil Extended Producers Responsibility for Plastic Packaging as per Schedule 2- (i) Producer (P) of plastic packaging; (ii) Importer (I) of all imported plastic packaging and / or plastic packaging of imported products; (iii) Brand Owners (BO) including online platforms/marketplaces and supermarkets/retail chains other than those, which are micro and small enterprises as per the criteria of Ministry of Micro, Small and Medium Enterprises, Government of India.; (iv) Plastic Waste Processors Sub- Rule (2) Primary responsibility for collection of used multi-layered plastic sachet or pouches or packaging is of Producers, Importers and ...

Representative photo of plastic trash in water: Naja Bertolt Jensen/Unsplash • The Plastic Waste Management (Amendment) Rules 2022 is a mixed bag of ideas and a test case for experimenting with new concepts. • The biggest challenge will be to implement highly ambitious recycling and reuse targets in a country where various existing waste management rules haven’t been implemented. • Going forward, there is an urgent need to seek policy solutions that reflect the social, cultural and political realities of the country. • The ‘polluter pays’ principle at the heart of the amendment could easily be reduced to a “pay to pollute” arrangement between the government and plastic producers. The Ministry of Environment, Forests and Climate Change announced the Plastic Waste Management (Amendment) Rules 2022 on February 16. The new law comes less than a week before the pre-meeting discussions of the fifth session of the UN Environment Assembly in Nairobi, Kenya. The top agenda item here is no. 5.2 – to reach a consensus on a binding global agreement on plastic pollution. If things go as planned, members of the treaty will have to commit to reducing their plastic footprint.
