Rahul Gandhi’s bail extended in defamation case; next hearing on April 13

Congress leader Rahul Gandhi was on Monday granted bail extension by the Surat sessions court and his next date of hearing has been fixed for April 13. Gandhi was granted bail and his sentence was suspended for 30 days allowing him to appeal the decision. (Facebook | Rahul Gandhi) Surat court has also asked respondents to file a reply by April 10 in the case. The development comes in wake of the 2019 criminal defamation case where he was disqualified from Lok Sabha after being sentenced to two years in prison. In his plea, Gandhi had asked the court to set aside the magistrate order convicting him in the defamation case. He also sought for an interim stay on the conviction till the matter was disposed off. The Gujarat Congress released a statement on the developments that took place in the court. “Rahul Gandhi has been granted bail by a Surat court in a defamation case. The next hearing will be held on April 13 and further hearing will take place on May 3. A hearing could not be held today as the complainant and his lawyer were not present in the court. A large number of Congress party workers, leaders and office bearers from all over Gujarat and other states were present in support of Rahul Gandhi in order to save democracy and oppose the dictatorial approach of this ruling government,” according to a statement by Gujarat Congress. PTI Surat, April 3 A sessions court in Gujarat's Surat city on Monday granted bail to Congress leader Rahul Gandhi after he filed an appeal against his conviction in a criminal defamation case over his 2019 "Modi surname" remark in which he has been sentenced to two years in jail, a lawyer said. The court of Additional Sessions Judge RP Mogera said it will hear his plea for suspension of conviction on April 13 after issuing a notice to complainant Purnesh Modi, a Bharatiya Janata Party (BJP) MLA and former Gujarat cabinet minister. The sessions court asked the respondent (Purnesh Modi) to file his reply by April 10. "We had filed an application for Rahul Gandhi's bail and suspension of sentence along with his appeal against conviction by a lower court. The (sessions) court heard the matter and granted him bail. The court kept the matter for hearing on the stay of his conviction for April 13," a member of his legal team told reporters. Rahul Gandhi, who arrived in Surat earlier in the day, will not be required to appear in the court during the hearing of the case, he said. Surat: Congress leader Rahul Gandhi was granted bail today in a 2019 defamation case and his two-year jail sentence was paused until a decision on his appeal challenging his conviction. A Gujarat court will take up his appeal on April 13. Mr Gandhi, accompanied by sister Priyanka Gandhi Vadra and several other Congress leaders including three Chief Ministers, approached Surat's sessions court with an appeal to set aside his conviction over his "Modi surname" comment seen to be an insult to Prime Minister Narendra Modi. The former Congress president need not appear in court for the next hearing. After the court order, Mr Gandhi tweeted he is fighting against "Mitrakal", alluding to the ruling BJP, often the target of the Congress over allegations of misusing government agencies to harass the opposition. Rahul Gandhi was granted bail by a Surat Sessions Court Monday, April 3. Gandhi, the 52-year-old Congress leader, was convicted in a criminal defamation case earlier which attracted a sentence of two years. Consequently, Rahul Gandhi lost his place in the Lok Sabha. The next hearing of the case will be held on April 13. Rahul Gandhi had filed a plea before the Surat Sessions Court seeking a stay on his conviction. It was owing to this conviction that led the Congress leader to lose his seat in Parliament in accordance with the Representation of People Act. After securing bail, Gandhi, flanked by other leaders of the Congress party marched out of the court premises walking into a protest march. Ahead of the hearing in the Surat Sessions Court, Rajasthan Chief Minister Ashok Gehlot said, "We trust the judiciary. We are here to show our unity. We are doing 'satyagraha' to save the country. The country is seeing how Indira Gandhi's grandson and Rajiv Gandhi's son, Rahul Gandhi is treated today."
