Rajasthan rte rules__29-03-2011 • Education (Gr-1) Department No.F.21(19)Edu.-1/E.E./2009 Jaipur, dated March 29, 2011 Notification In exercise of the powers conferred by section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (Central Act No. 35 of 2009), the State Government hereby makes the following rules, namely:- 1. Short title, extent and commencement.– (1) These rules may be called the Rajasthan Right of Children to Free and Compulsory Education Rules, 2011. (2) They shall come into force with immediate effect. (3) They shall extend to the whole of the State of Rajasthan. PART-I PRELIMINARY 2. Definitions.- (1) In these rules, unless the context otherwise requires, - (i) “Act” means the Right of Children to Free and Compulsory Education Act, 2009 (Central Act No. 35 of 2009); (ii) “Anganwadi” means an Anganwadi Centre established under the Integrated Child Development Services Scheme of the Ministry of Women and Child Development of the Government of India; (iii) “Block Elementary Education Officer” means the officer in charge for elementary education in a Block; (iv) “child with disability” means a child covered under the definition of “person with disability” under clause (t) of section 2 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995; (v) “Commissioner/ Director Sarva Shiksha Abhiyan” means the Head of the Rajasthan Council of Elementary Education; 1 • “Director, Elementary Edu...

Education is a concurrent subject implying concurrent responsibility for both the Centre and State. The Right of Children to free and compulsory education Act, 2009 was enacted by the Parliament. Subsequently, state governments have framed the rules under the RTE Act. Also, both MHRD and State Governments have released several notifications related to RTE Act. The State legislatures have enacted their own school education Acts three-four decades back. These Acts have their corresponding rules. Also, notifications are being issued by the State Education Department from time to time. Here you can find a comprehensive list of Acts, Rules & Notifications governing the elementary education space in your state. The 86th amendment to the constitution making education a fundamental right, and subsequent enactment of the Right of Children to Free and Compulsory Education Act giving effect to the constitutional amendment, has resulted in a big role for judiciary in ensuring that education as a right of a child isn't violated. With RTE coming into force on Apr 1, 2010, there has been a plethora of cases filed in the High Courts and Supreme Court. Here, you can find the High Court judgements of your state. The Right to Education Act ,2009 connotes the commitment of India to strengthen elementary education for all children in the country. It was desired in the conception and implementation of the RTE Act that all children in the age group of 6-14 would have free and compulsory education which was qualitative and inclusive. The RTE Act came into force on April 1, 2010 in Rajasthan. Henceforth, sseveral measures have been taken by the state government in terms of laying down State Rules, guidelines, policies, stricter regulations for private schools, to ensure that the RTE Act is properly implemented. Unfortunately, these measures have not altered the education scenario and the true benefit in term of children learning and developing seems miles away. Data indicate that the public system of education and the learning curve of children have seen a downward trend. A literature review is actually an attempt to identify, locate ad synthesize completed research reports, articles, books and other materials relevant to the specific problems of a research topic. However, when new studies are undertaken in which materials are not available, the researcher need not ponder over previous studies. The literature review provides a background and context for the study, exploring the output of previous scholarship in an area.
