Maharashtra political row: Can’t restore Uddhav govt as he resigned without floor test, says SC

In the matter related to the Maharashtra political crisis, a five-judge Constitution bench of the Supreme Court led by Chief Justice DY Chandrachud held that it cannot order the restoration of the Uddhav Thackeray government as he resigned without facing a floor test, reported Live Law. A Constitution bench of the Supreme Court on Thursday pronounced the crucial judgement in the case related to the rift within the Uddhav Thackeray and Eknath Shinde camps of the erstwhile Shiv Sena party, which led to the collapse of the Uddhav Thackeray government in Maharashtra in July last year. Karnataka cabinet list 2023: Full list of ministers and their portfolios “The Speaker was aware of the emergence of two factions in the legislative party on 3 July 2022 when he appointed a new whip,” the bench said. “The Speaker did not attempt to identify which of the two persons – Mr. Prabhu or Mr. Gogawale- was the whip authorised by the political party. Speaker must recognize only the whip appointed by the political party,” the CJI said. The apex court bench also referred the 2016 Nabam Rebia five-judge verdict related to power of speaker on disqualification of MLAs to a larger bench, and said that issues such as whether motion for Speaker’s removal will restrict his powers to issue disqualification notices need examination, reported Live Law. A five-judge Constitution Bench started hearing the batch of petitions related to the case in February. The batch of petitions includes one filed by Ek...

Last Updated: 13th July, 2022 17:51 IST Maharashtra News Updates: Shiv Sena Backs Droupadi Murmu; Congress Cries Foul The Supreme Court will list a bunch of pleas filed by Shiv Sena pertaining to the political upheaval in Maharashtra after a few days. While the Eknath Shinde camp has moved the SC against the disqualification proceedings against them, the Uddhav Thackeray faction has challenged the formation of the Eknath Shinde-Devendra Fadnavis government and the subsequent proceedings. NCP's Jayant Patil said, "I don't see any possibility of MVA to go separate from Uddhav Thackrey. No, if Uddhav ji has supported Draupadi Murmu ji then it doesn't mean he is in NDA now. It is history if Shiv Sena that if any Shiv Sainik leaves party then he always comes winning that respective seat. Uddhav Thackrey ji is of soft nature and he will come back with more power. MVA is still intact. Subhash Desai's letter is signaling at making the same person cm again whom once removed and in Maharashtra you will see this happening." In a press conference, NCP spokesperson Mahesh Tapase said that Shiv Sena (Uddhav Faction) has not officially issued any statement declaring their support for Droupadi Murmu as the presidential candidate. He said, "Uddhav ji has not yet officially declared support for Droupadi. There is rebellion in Shiv Sena. NCP and Congress are standing with Uddhav ji. We recognize Uddhav Thackeray faction as the real Shiv Sena." On whether 12 Lok Sabha MPs will join his factio...

In 'Who Is Real Sena' Fight, Supreme Court Breather For Team Thackeray

New Delhi: In a big relief to Uddhav Thackeray in the fight over control of the Shiv Sena, the Supreme Court today told the Election Commission not to decide on a plea by Eknath Shinde, the Maharashtra Chief Minister, to recognise his group as the real party. Here are the top 10 updates on this story: • The Supreme Court is likely to take a call on Monday on whether the matter needs to be referred to a constitution bench. • Claiming that he commands the numbers - and, therefore, the Sena - Mr Shinde had submitted that courts shouldn't interfere with internal party decisions "taken democratically by majority". • During the hearing today, Chief Justice NV Ramana asked important questions to Team Shinde, wanting to know "if you are completely ignoring political parties after being elected then is it not a danger to democracy". To this, senior advocate Harish Salve, who represented the Shinde camp, replied: "No". • Team Thackeray doesn't want the Election Commission to decide yet. Earlier, Team Thackeray told the Supreme Court that the poll panel can't decide which group represents the Shiv Sena till there is clarity on the disqualification of rebel Sena MLAs - who hopped from Gujarat to Assam to Goa in a political operation last month - and dethroned Mr Thackeray. • In their petition, Team Thackeray said the Shinde group is trying to "illegally cobble up numbers and fabricate an artificial majority in the organisation". • The Election Commission had sought evidence from both s...
