The Kerala High Court Tuesday dismissed the writs filed by the All India Digital Cable Federation (AIDCF) challenging 2022 amendments to the TRAI’s regulations and amended new tariff order (NTO 3.0) in respect of provisioning of TV channels. The HC had reserved the judgement on March 7, 2023, which was pronounced earlier today. In February, three leading broadcasters, Disney Star, Zee Entertainment Enterprises and Sony Pictures Networks India Ltd, stopped providing feed to cable operators which have not signed fresh agreements with increased prices under the New Tariff Order (NTO) 3.0. The NTO had come into force in February 2023. Earlier, the broadcasters had issued notices on February 15 to cable operators/ multi system operators to sign the new RIO for New Tariff Order. As a result, DTH and cable operators have expressed concerns earlier over the potential increase of approximately 30% in TV channel prices for consumers. In addition, this tariff hike could lead to a loss of subscribers for these operators, especially as the trend of cord-cutting may further accelerate with the rise of OTT channels. Television broadcasters have increased their bouquet and popular channels' prices between 10-15% under the new amendments to the tariff order, or NTO 3.0. Broadcasters claim it's the bare minimum, as there has been no price increase over the last four years. However, the cable operators are against broadcasters on the issue of a hike in MRP of channels and bouquets in compliance with the amended new tariff order (NTO 3.0) implemented by the Telecom Regulatory Authority of India (TRAI). The Telecom Regulatory Authority of India (TRAI) has extended the deadline for implementing New Tariff Order (NTO) 2.0 to 28th February 2023. The regulator said that the deadline has been extended due to the ongoing consultation process and requests received from the stakeholders. Under the New Regulatory Framework 2020, broadcasters will now have to report to the authority, any change in name, nature, language, Maximum Retail Price (MRP) per month of channels, and composition and MRP of bouquets of channels by 30th November 2022, and simultaneously publish such information on their websites. The broadcasters who have already submitted their RIOs can revise their RIOs by 30th November 2022. Likewise, DPOs will have to report to the authority, Distributor Retail Price (DRP) of pay channels and bouquets of pay channels, and the composition of bouquets of pay and FTA channels by 31st December 2022 and simultaneously publish such information on their websites. DPOs who have already submitted their RIOs may also revise their RIOs by 31st December 2022.
