UPOR to be a reality soon, concerns remain

The land and property prices are at a premium in the city of Bengaluru. As a result, today land scams dominate the legal scene, while many properties do not have clear ownership records. A study conducted by Mckinsey in India showed that India loses 1.3% of its potential growth due to poorly maintained land records. Much of the registration process in India does not result in valid ownership titles. Hence, more than 70 per cent of legal disputes are land-based, says a policy brief on Urban Property Ownership Record (UPOR) prepared in 2018 by Bengaluru-based Institute for Social and Economic Change (ISEC). It lists an unnatural increase in the demand for urban property, the creation of fake documents, ‘benami’ and fraudulent land transactions, insufficient checks/controls at various official levels for monitoring irregularities etc as the problems associated with urban land transactions. UPOR was envisioned as a solution to eliminate these problems. What is UPOR? As per the Karnataka Land Revenue (KLR) Act of 1964 and KLR Rules of 1966, the state’s Revenue Department has been mandated to prepare, maintain and preserve spatial and nonspatial data relating to ownership of land for urban properties in urban areas of Karnataka. UPOR is a record that captures the location, dimension, area, ownership details and legality of a property. Bengaluru Digitizes Property Ownership with Unique UPOR Cards

The project is being implemented by Survey Settlement and Land Records (SSLR) staff, who use drone surveys to identify property boundaries. BENGALURU: The Urban Property Ownership Records (UPOR) project has provided over 400,000 property owners in Bengaluru with digitized and georeferenced property cards containing a unique land property identification number. These cards contain all the details related to the property and aim to issue property cards for all 2.5 million properties located in Bruhat Bengaluru Mahanagara Palike (BBMP) limits. The project is being implemented by Survey Settlement and Land Records (SSLR) staff, who use drone surveys to identify property boundaries. The SSLR has collected property data from BBMP and completed drone surveys for approximately 1.5 million properties. Government Providing Digitized and Georeferenced Property Cards with UPOR Prpject The UPOR project team sends a notice to property owners after a drone survey to inform them about a surveyor visiting to measure the property. Property owners must present documents such as tax payment receipts, sale deeds, copies of BBMP khata/RTC, encumbrance certificates, possession certificates, allotment letters, approved layout plans, alienation order copies, owner's photographs, and property pictures. Over 92,000 property owners issued new IDs under UPOR cards

The state government, as part of its initiative to create unique land property identification numbers for properties, has completed drone-flying in 198 BBMP wards. Data verification and review of documents for more than 3.5 lakh properties spread across 109 wards are still in progress. According to the revenue department, over 92,000 property owners have already been given their new IDs — under Urban Property Ownership Records (UPOR) cards. Aside from Bengaluru, a similar exercise is being carried out in five other districts of the state —Ramanagara,Tumakuru,Belagavi,HassanandUttara Kannada. According to the government, drone surveys are being conducted for all agricultural and urban lands as part of the land resurvey project. “Boundaries are identified using images captured through the drone survey and overlaid on satellite images available to create property rights and other documents,” the government said. Asked about the survey and progress in the remaining wards, BBMP chief commissioner Tushar Giri Nath, said: “When we start the survey, we’ll tell you.” Citizen activist Nagesh Aras, however, pointed out: “A digitisation initiative was carried out six years ago but people are not aware of it. Vendors were supposed to get paid but that has not happened. The project was piloted in Jayanagar and Ramanagara in 2018 using drone survey. Later approval was given for a two-phase massive study in Tumkur, Hassan, Uttara Kannada, Belgaum, Ramanagara and Bengaluru. An inclusive plan was devised in the initial phase of the survey of 50 thousand square km of these above areas. Property owners can apply for the card. The revenue department physically marks their property boundary. Images of the property are captured by drones and physically demarcated. Then the owner of the property will be informed through e-mail and asked to upload all the documents related to the property on UPOR website. BBMP documents and official documents uploaded by the owner are compiled together to prepare a draft. These cards will be used to get bank loans, in property related disputes in court, to prove ownership in local administrations, sub registrar’s office, to file a case in court for property sharing, in case of building construction or conversion, while giving bail for someone else in court-police station.

Out with the Khata, in with the Property Card

JP Nagar resident M Srinath had relinquished his property in Jayanagar 8th block for Metro construction last year. The property was part of BDA layout, and was supposed to measure 1500 sq ft. During the acquisition, KIADB (Karnataka Industrial Areas Development Board) which was in charge of the acquisition, had got the city survey department to measure the land. The department found that the property in fact measured 1530 sq ft. KIADB assured Srinath that he would compensation for the entire 1530 sq ft if he managed to get a letter from the BDA. "I do not plan to pursue it with BDA as it might take at least two years to get BDA’s approval. But the survey was useful; I would not have known of the actual area without it," says Srinath. Property Card (UPOR) Mandatory, Documents Collecting Drive from October – DC Senthil Mangaluru: The Urban Property Ownership Record (UPOR) certificates are mandatory for all transactions involving Urban properties. In absence of this certification no transaction on property will be allowed by the government. It is compulsory to make the property card for those owning property within MCC limits. We have divided 32 villages that come under MCC limits into 6 zones and 30 sectors. The satellite survey of 1,50,428 properties under MCC limits and the collection of documents of 76608 properties is already done. Those who have not applied for the Property card should apply by December 2018″, said the deputy commissioner Sasikanth Senthil in a press meet held at the DC’s Court hall here on September 20. BENGALURU: Over four lakh property owners in Bengaluru were given digitized and georeferenced property cards with a unique land property identification number under the Urban Property Ownership Records (UPOR) project till mid-April. The UPOR cards issued by the revenue department card contain all the details related to the property. The project aims to issue property cards for all 25 lakh properties located in Bruhat Bengaluru Mahanagara Palike (BBMP) limits. The UPOR project is being implemented by staff at Survey Settlement and Land Records (SSLR). An SSLR officer said the project was started in 2022. The boundaries are identified using images captured through drone survey. The survey has been completed in 158 of the erstwhile 198 wards, and the same will be done in remaining 40 wards in the next few months. SSLR collected property data from BBMP and the drone survey was completed for around 15 lakh properties. The UPOR project team sends a notice to property owners soon after the drone survey to inform them about a surveyor visiting to measure the property. Cabinet nod for urban property card introduction in Bangalore

The Urban Property Ownership Record (UPOR) card is to be introduced in Bangalore. Briefing reporters after the Cabinet meet, the State Law Minister and Municipal Administration, Mr S. Suresh Kumar, said, “UPOR card is being issued to property owners in Bangalore city to prevent fake and fraudulent transactions.” In phases “The total cost of UPOR card introduction in the city is estimated to be Rs 9.48 crore. “The Cabinet today approved a plan to introduce cards in phases. In the phase I, two zones involving 50 wards at a cost of Rs 4.74 crore will be taken up,” he added. The card is also to protect the interest of genuine property owners and when implemented is said to identify encroachment of government land and also detect multiple ownerships creating problems to financial institutions. The scheme has been taken up in other cities such as Mysore, Shimoga, Bellary, Mangalore and Hubli-Dharwad. Department of Survey and Settlement is the implementing authority. The Cabinet has also approved the setting up of ‘Centre for Innovation and Good Governance' in Bangalore.
