If you lose your keys, the best course of action is to contact the police and file a report. They may be able to help you locate your keys or, if necessary, issue you a new set. May traffic officer remove my key or impound my car?

By Sanette Viljoen It has often been brought to my attention that people are pulled off by traffic officers, who then want to remove the keys from the car. May a traffic officer do this? This is not part of the normal performance of a traffic officer’s duties. The traffic officer’s job is, for instance, to inform the person that he or she was driving too fast, to show his or her driver’s licence, and then to give the person a fine. However, in practice it does not always happen like this and sometimes a heated argument follows or the officer tries to remove your car keys without a valid reason. The next question is: what is the officer’s purpose and why does he want to take your keys? Unfortunately the answer to this question is corruption. In this situation many motorists will rather pass the officer money under the counter to avoid the uncomfortable situation. In the case of a totally unroadworthy vehicle it can of course be impounded or confiscated, but then the complete vehicle must be confiscated and not only the keys. In a case where the driver is a total danger to other road users, the officer may refuse to let the person drive on, and to do this the officer may confiscate the keys. An officer may also confiscate your vehicle during a road block where, for example, drugs or illegal firearms are found in your vehicle. The peace officer will then regard the vehicle as part of the evidence in the subsequent court case. Your vehicle may then be impounded. In other cases...

Can a police officer take your car keys away from you?

I was involved in a routine traffic stop. The officer was being very rude. He took my license away from me because it was out of state....even though it is a valid driver's license. Then he made me hand my keys over to him. He then threatened to take me to jail and toe my car. I had to get my son to come to me so he could drive my car. The officer refused to hand me the keys and instead insisted on handing them to my son. He said that because I had not transferred my license to Massachusetts, that it was the invalid. More G. L. c. 90, § 10, allows a nonresident to drive in Massachusetts under a valid foreign license. Once a person becomes a Massachusetts resident, his or her out of state license is invalid and the person must obtain a Massachusetts license to drive in this state. There is no "grace period." This is not intended as legal advice and it should not be considered or relied upon as such. More You are the third person this week (that I've read) who has reported something that happened, and then asked if it can happen. The answer is yes, it can happen, and the proof for that is that it did happen. The officer can take your keys away from you... and he did! I'm not saying this is right. It sounds perhaps like he overreacted. You say that you had not yet transferred your license to Massachusetts, which seems to suggest that you had moved recently. How long was it? By law you are supposed to get a Massachusetts license within 30 days after moving into the state. So i...

Is a US (New York) police officer allowed to take your keys at a traffic stop?

So I was browsing Reddit earlier and came across So in short, my question is this: Is a US police officer (New York specifically) allowed to take your car/ bike keys without asking for consent first? If this is state specific, it would be awesome to see a list of states where this is legal/ illegal Edit: I should've mentioned that, yes, taking the key to ensure the motorcycle is immobilized and cannot run (as motorcycles/ motorcyclists tend to do more often citation needed) is probably the reason as to why. But I'm not asking about why the police officer did it @MonkeyZeus, that first one wasn't a direction given by the officer. (It matters, because for many, breaking a law in a way that doesn't harm anyone might be quite different from actively disobeying a policeman.) For the second, it's a bit hard to hear both the order to turn it off and the engine noise from the video, but it's there, the brup-brup from the engine clearly cuts well before the policeman gets at the key (at about 0:09) in the video. On my car, if an officer takes the keys, I can still start the car unless he or she moves a few meters away from my car. Usually my car keys are in my trouser pockets all the time and I never take them out. I can even drive away, but then I won't be able to start again because my keys are not there. The policeman ordered, right as he took a step out of his car "Turn it off!" - which is a lawful demand to prevent the biker from possibly kicking the gas and running. As the dr...
