Indian opposition leader Rahul Gandhi avoids prison as he appeals defamation verdict

The prosecution of Gandhi, the great-grandson of India’s first prime minister and scion of the dynastic Congress party, was widely condemned by opponents of Modi as the latest assault against democracy and free speech by a government seeking to crush dissent. The speed of his removal from Parliament shocked Indian politics. Gandhi appeared in a court in the western state of Gujarat on Monday to file an appeal and was granted bail for the duration of the appeal process. He was granted bail for 30 days to file an appeal when he was convicted last month. The court set the next hearing for April 13. “In this struggle, truth is my weapon and truth is my support,” Gandhi tweeted after Monday’s hearing. He waved to supporters and Congress party members who gathered outside the court. A man who shares the prime minister’s surname, Modi, which is common in his home state of Gujarat, accused Gandhi of defamation over a 2019 speech in which he asked, “Why do all thieves have Modi as their surname?” Gandhi then referred to three well-known and unrelated Modis in the speech: a fugitive Indian diamond tycoon, a cricket executive banned from the Indian Premier League, and the prime minister. The petitioner who filed the case is a member of Modi’s Bharatiya Janata Party in Gujarat but is not related to the prime minister or the other two Modis mentioned by Gandhi. By Press Trust of India: The BJP has filed a defamation complaint against Congress leader Rahul Gandhi, Chief Minister Siddaramaiah, Deputy Chief Minister D K Shivakumar, and Karnataka Pradesh Congress Committee (KPCC), before the Additional Chief Metropolitan Magistrate Court. The special court exclusively to deal with criminal cases related to elected former and sitting MPs/MLAs has taken cognisance of the offences under Sections 499 (defamation) and 500 (punishment for defamation) of the Indian Penal Code and posted the case for recording the sworn statement on July 27. The private complaint alleging false claims in advertisements tarnishing the image of the BJP was filed by the party's state secretary S Keshavaprasad on May 9. According to the complaint, the advertisement released by the KPCC in major newspapers on May 5, 2023 in the run-up to the Assembly election claiming that the then incumbent BJP government indulged in "40 per cent corruption" and had looted Rs 1.5 lakh crore in the previous four years was "baseless, prejudiced and defamatory". Kota: Congress workers led by party’s Kota district president and party leader Amit Dhariwal began an aggressive protest against disqualification of party’s national leader “At least 500 party workers, including women, offered voluntary arrest. The protest would be further intensified if a decision on disqualification of Rahul Gandhi as member of parliament was not revoked,” said district Congress president Ravinder Tyagi. However, a senior district official said that around 300 party workers surrendered for voluntary arrest. Tyagi further alleged yjay an attempt was underway to trample the prominent leaders of the opposition in the country. Referring to post emergency period, Tyagi said the then Prime Minister Morarji Desai in 1978 disqualified parliamentary membership of party leader Indira Gandhi and got her arrested, following which Jail Bharo Andolan was initiated across the country. “The scenario is same and the party workers would offer voluntary arrest and Modi would have to bow down by revoking Rahul Gandhi’s membership in the parliament,” he said.
