SECI Wins Crucial Case At APTEL On Trading Margins, For Now

Highlights : • APTEL’s judgement should put a stop, for now, across discoms chafing at the 7 paise trading margin of SECI. • It does open the gates to harder negotiations in future contracts, however. Especially from the larger and financially healthier discoms, as they mend their books. The Ruling against orders by the Delhi and Punjab regulators will be a relief to the central agency. In a detailed 77 page Without getting into the specifics of the order, the key issues that APTEL has tackled are the jurisdiction of state regulators, and the right of state regulators to make any modifications whatsoever to a contract between two parties in this case, between SECI and solar power developers, and secondly, between SECI and state discoms. On the first issue, APTEL, quoted that “The power and jurisdiction of the State Commission under Section 86(1)(b) concerns source, quantum and price (tariff) of procurement by the distribution licensee. In inter-State transaction it is bound to follow the regulatory regime or determination of trading margin by the Central Commission and cannot sit in judgment over its propriety.” In this case, with power being sourced from projects outside the state/s, CERC’s write reigns supreme, as clearly repeated by APTEL. On the second contention of the state discoms, wherein they had sought to exploit a condition of 2 paise per unit of trading marin for short term contracts, and extrapolate it to longer term contracts, APTEL ruled that “There was no p...

Assembly directs $11.8 million in federal relief toward possible Anchorage hotel purchase for low

Updated: August 13, 2022 Published: August 13, 2022 The Aptel Studio Hotel, in northeast Anchorage, will likely become low income and supportive housing units, purchased with federal relief funds. (Anne Raup / ADN) The Anchorage Assembly has finalized how the city will spend $51 million in federal relief funds, giving the largest chunk, nearly $11.9 million, to the Rasmuson Foundation for the purchase of low-income and supportive housing units. It identified the Aptel Studio Hotel in northeastern Anchorage as the likely building. The project is among more than 65 that the Assembly approved federal funding for this week, prioritizing efforts to support housing, children and families, economic development and workforce development. The federal funds came via the American Rescue Plan Act, a $1.9 trillion relief bill meant to help mitigate impacts of the COVID-19 pandemic. The city spending package, finalized Tuesday, comes as the city faces a the only option is In a last-minute switch, the Assembly directed the money for the hotel to Rasmuson instead of the Alaska Community Foundation, as previously planned. The move cuts the city — and Bronson’s administration — out of the deal entirely. The community foundation would have needed signatories to release the money for the purchase, and that would require the administration to sign. The voting-bloc majority of Assembly members say Bronson’s actions have created a humanitarian crisis at Centennial, and that they have little, if ...

APTEL Denies Tariff Cut for a Delayed Solar Project, Allows Recovery of Liquidated Damages

The Appellate Tribunal for Electricity ( However, Azure Photovoltaic, the solar developer, was entitled to a tariff of ₹6.96 (~$0.094)/kWh to supply power to GESCOM from the project’s commercial operation date (COD), APTEL said. It directed the DISCOM to pay the solar developer the differential tariff between ₹6.96 (~$0.094)/kWh and ₹6.51 (~$0.088)/kWh from the commercial operation date until it starts paying ₹6.96 (~$0.094)/kWh. The parties were told to submit the supplementary power purchase agreement (PPA) executed between the solar developer and GESCOM for approval. Azure Photovoltaic had appealed to APTEL challenging the Karnataka Electricity Regulatory Commission’s ( Background Azure Photovoltaic is a special purpose vehicle (SPV) of Azure Power India. In 2014, the Karnataka Renewable Energy Development Limited ( Azure Photovoltaic entered into a PPA with GESCOM on January 23, 2015, and received the PPA copy from GESCOM only in April 2015. On May 25, 2015, GESCOM informed the developer that the PPA had been approved by the Commission. However, after signing the modified PPA, Azure Photovoltaic requested GESCOM to grant an extension to meet the commercial operation date. Later, GESCOM extended the commercial operation date to January 23, 2017. The draft supplemental agreement to the PPA handed over by GESCOM to the developer for execution lowered the tariff to ₹6.51 (~$0.088)/kWh. However, the developer had signed for a tariff of ₹6.96 (~$0.094)/kWh in the original PP...

APTEL’s Stay on REC Trading has Significantly Impacted the Renewable Market: Interview

Renewable energy certificates (RECs) play a vital role in helping companies meet their renewable purchase obligations (RPOs). They encourage the sale and growth of renewable energy and help the country meet its national renewable energy goals. However, these certificates have not been traded since the Appellate Tribunal for Electricity’s (APTEL) Mercom spoke to Rohit Bajaj, Head and Senior Vice President-Business Development, Indian Energy Exchange Limited ( Here are the edited excerpts from the interview: How has APTEL’s decision to postpone REC trading affected the market? The APTEL’s order to stay REC trading resulted in the halt of trade for four months now and has significantly impacted the renewable energy market. This has created an impediment for obligated entities such as distribution utilities, industrial consumers, and captive power producers who cannot buy RECs to meet their RPO requirements. At a time when companies are facing severe liquidity problems due to the impact of COVID-19 on the economy, pausing trade of a competitive and efficient REC market is making developers suffer enormously, and they are missing on their compliance trajectories. In fact, an ideal way of addressing this issue would be to allow the trading to happen as scheduled and then to ensure that adjustments are made retrospectively as per the APTEL’s final order. This would have ensured that obligated entities could continue to buy RECs as planned without falling behind their targets. Mor...
