Article 124 Maiming

ARTICLE 124 MAIMING This article covers those incidents where a service member inflicts injuries on another that mutilates, disables or significantly diminishes the latter's vigor. The accused is guilty of violating this article if he has carried out this act with deliberate intent to injure. The elements to be proved under this article are as follows: • That at a specific time and place, the accused, without any excuse or justification, inflicted a specific injury upon the victim. • That this injury either a) mutilated the victim and thus caused serious disfigurement of the victim, or b) disabled or destroyed a body part of the victim, or c) severely reduced the physical vigor of the victim by injuring a body part or any organ. • That the accused did this act with the deliberate intent to cause physical injury. Note: Disfigurement means that the accused' injury has caused visible damage to the victim's person so that his appearance was caused to significantly detract from his normal appearance. MAXIMUM PUNISHMENT The accused faces a maximum punishment of dishonorable discharge, forfeiture of all pay and allowances and 20 years confinement if he is proven guilty of this offense. Offenses under this article that occurred before October 1 st 2007 are punished with dishonorable discharge, forfeiture of all pay and allowances and 7 years confinement. UCMJ Article 124a Bribery The Any service member may be subject to prosecution under Article 124a if they occupy an official position or who have official duties; and who wrongfully asks, accepts, or receives a thing of value with the intent to have the person’s decision or action influenced with respect to an official matter in which the United States is interested. Service members are also subject to prosecution if they wrongfully promise, offer, or give a thing of value to another person, who occupies an official position or who has official duties, with the intent to influence the decision or action of the other person with respect to an official matter in which the United States is interested. In order to be prosecuted for asking, accepting, or receiving a bribe, it must be demonstrated that: • the accused wrongfully asked, accepted, or received a thing of value from a certain person or organization; • the accused then occupied a certain official position or had certain official duties; • the accused asked, accepted, or received this thing of value with the intent to have the accused’s decision or action influenced with respect to a certain matter; and • this certain matter was an official matter in which the United States was interested. C1936 Constitution of the USSR, Part IV 1936 CONSTITUTION OF THE USSR Adopted December 1936 CHAPTER X FUNDAMENTAL RIGHTS AND DUTIES OF CITIZENS ARTICLE 118. Citizens of the U.S.S.R. have the right to work, that is, are guaranteed the right to employment and payment for their work in accordance With its quantity and quality. The right to work is ensured by the socialist organization of the national economy, the steady growth of the productive forces of Soviet society, the elimination of the possibility of economic crises, and the abolition of unemployment. ARTICLE 119. Citizens of the U.S.S.R. have the right to rest and leisure. The right to rest and leisure is ensured by the reduction of the working day to seven hours for the overwhelming majority of the workers, the institution of annual vacations with full pay for workers and employees and the provision of a wide network of sanatoria, rest homes and clubs for the accommodation of the working people.
