The Gujarat government will move the high court to challenge the acquittal of self-styled godman Asaram's wife, their daughter and his four disciples in a 2013 rape case in which he was sentenced to life imprisonment, an official said on Thursday. A court in Gandhinagar on January 31 sentenced Asaram to life imprisonment in the rape case filed by his former woman disciple in 2013. Asaram's wife Laxmiben, their daughter Bharati, and his four disciples, who were accused by the prosecution of aiding and abetting the crime, were acquitted by the court for want of evidence. The prosecution has also sought the government's consent to challenge the Gandhinagar court's January 31 order, in which it suggested that life sentences for Asaram in Jodhpur and Ahmedabad cases should run concurrently. The government's consent for the same is awaited, Kodekar said. The octogenarian godman is currently serving a life term in a Jodhpur jail in another case of raping a minor girl at his ashram in Rajasthan in 2013. The Gandhinagar court sentenced Asaram in the case for raping a woman disciple, who hailed from Surat, on several occasions from 2001 to 2007 at his ashram at Motera near Ahmedabad before her escape. Gandhinagar: More than nine years after a former disciple of Sessions court judge DK Soni acquitted six other accused, including Asaram's wife Laxmiben, their daughter, and four disciples who were accused of aiding and abetting the crime, for want of evidence, the prosecution said. Asaram's lawyer said the session court's order will be challenged in the Gujarat High Court. Notably, the victim's younger sister was raped and illegally confined by Asaram's son Narayan Sai. Sai was sentenced to life imprisonment by a sessions court in Surat in April 2019 in the rape case filed against him by his former disciple in 2013. As per the FIR (First Information Report) registered at Chandkheda police station in Ahmedabad on October 6, 2013, against Asaram Bapu and six others, the self-styled godman had raped the woman disciple, who hailed from Surat, on several occasions from 2001 to 2006 when she was living at his ashram at Motera near Ahmedabad before she managed to escape. A chargesheet was filed in July 2014. "The court convicted Asaram Bapu under sections 376 2 (C) for rape, 377 (unnatural offences), 342 (Wrongful detention), 354 (assault or criminal force to woman with intent to outrage her modesty), 357 (assault) and 506 (criminal intimidation) of the Indian Penal Code," said special public prosecutor RC Kodekar. Asaram bail plea: His counsel Swamy fails to turn up in court

Noted lawyer Subramanian Swamy today failed to appear before a local court here for the third time to argue for the bail application of imprisoned Asaram Bapu in connection with a case of sexual exploitation of a teenaged girl. The trial court now set June 16 as the new date for the hearing on the sixth bail application in any court by Asaram, who is lodged in Jodhpur jail for one-and-a-half year. Swamy, a BJP leader, had moved a bail application in the trial court on May 23 and the court had listed the matter for May 26. But Swamy did not appear in the court for arguments on his bail application on that day and the court then posted the matter for June 2, said P C Solanki, counsel for the victim girl. Swamy did not turn up on June 2 either, after which the court listed the matter for today. Asaram's counsel did not appear in the court today either for the "reason best known to him" and the court has posted the hearing for June 16, said Solanki. When asked about Swamy's absence, Asaram said, "He is a nice man and would definitely come. Nobody should question his integrity." This is the sixth bail application by Asaram in any court. Before this, five bail applications, two each in the trial court and the High Court and one in the Supreme Court have been rejected.

Kodekar had submitted that Asaram was a "habitual offender" and so he should be sent to jail for life, while the defence lawyer had sought minimum punishment.
