Chief Justice of India D Y Chandrachud on Thursday recused from hearing petitions seeking contempt of court action against stand-up comedian Kunal Kamra over some of his tweets. “Let the matter be listed before a bench of which I am not a member,” the CJI said as soon as the matter came up before the bench comprising him and Justice P S Narasimha. Although the counsel said they had no problem if he heard it, the CJI refused, saying, “No, the comments were made on the order, which I have passed.” The reference apparently was to a tweet made by Kamra in the wake of the November 2020 Supreme Court order granting bail to Republic TV editor-in-chief Arnab Goswami, who had challenged the Bombay High Court order rejecting his interim bail plea in the 2018 Anway Naik abetment-to-suicide case. The court is seized of a batch of pleas seeking action against Kamra, including one by law student Shrirang Katneshwarkar who contended that these tweets “scandalised” the top court and “further lowered” its authority. Kapadia, a little over 28 months, between May 12, 2010 and September 28, 2012. His immediate predecessor, the 37th Chief Justice K.G. Balakrishnan had a longer tenure of 39 months and 28 days. Such comparatively substantial tenures as Chief Justices of India have been few in the recent past of the court. After Chief Justice Balakrishnan, one has to count back till the 29th Chief Justice of India, Justice A.S. Anand, for a tenure which crossed two years between 1998 and 2001. Justice Anand was CJI for 36 months and 21 days. Justice A.M. Ahmadi too served 28.27 months as the 26th CJI. The year 2023 would see a slow change in the first phase of the Chandrachud Collegium with four of the senior members retiring, starting with Justice S. The Supreme Court witnessed a heated exchange Thursday between Chief Justice of India D Y Chandrachud and Supreme Court Bar Association (SCBA) President and senior advocate Vikas Singh over the hearing of a plea seeking land for lawyers’ chambers, with the CJI finally telling the senior counsel that he will not let himself be brow beaten. “Mr Singh, I am the Chief Justice of India. I have been on the bench for long. I have never let myself be brow beaten by Bar members and I will not let it happen in the final two years of my tenure. You will be treated as an ordinary litigant. Please don’t force my hand to do something you don’t want,” the CJI heading a three-judge bench said. Sexual abuse of children remains hidden problem, state must encourage families to report abuse: CJI

Image Source : PTI/FILE CJI Chandrachud Chief Justice D Y Chandrachud, on Saturday, termed the case of sexual abuse among children as the major concern and urged the parents to report the case to the police irrespective of whether the perpetrator is a family member. He said that there is a 'culture of silence' in the country when it comes to dealing with sexual crimes against children. His critical remarks about child abuse came during a two-day national programme on the Protection of Children from Sexual Offences (POCSO) Act. He asserted it is an unfortunate fact that the criminal justice system functions in a way that sometimes compounds the victims' trauma and the executive must therefore join hands with the judiciary to prevent this from happening. "The long-lasting implications of child sexual abuse make it imperative for the state and other stakeholders to create awareness regarding the prevention of child sexual abuse and its timely recognition and the remedy available in law," said CJI on Saturday. CJI Chandrachud bats for mediation as dispute resolution mechanism for individuals, govt

By PTI NEW DELHI: Chief Justice of India DY Chandrachud batted on Friday for adopting and encouraging mediation, including online mediation, as a mode of dispute resolution other than litigation, saying it would reduce the courts' caseload and has the potential to portray justice as collaborative rather than adversarial. The CJI said it would especially come to the aid of women from marginalised communities as mediation makes law less "intimidating" and less "alienating". He added that when the government, which is the biggest litigator but must "adopt the robes of a friend", opts for this process, a message is sent that the government itself is not an adversarial opponent. Justice Chandrachud was speaking at the inaugural session of a national conference on "Mediation at the Dawn of Golden Age", organised by Samadhan at the Delhi High Court. Samadhan or the Delhi High Court Mediation and Conciliation Centre was established in May 2006 to provide mediation as an appropriate method of alternate dispute resolution. During the session, the high court signed a memorandum of understanding with the Uttarakhand High Court in relation to expanding the mediation process in the hill state.
