Six new CJIs in six years likely, goes against law panel’s suggestion

Express News Service NEW DELHI: India will see six Chief Justices in a span of six years beginning this year. The current Chief Justice of India N V Ramana will head the institution for a year or so only. With a sanctioned strength of 34 judges, six positions of judges are lying vacant in the Supreme Court and four judges will retire by the end of this year. Three more judges will retire by August 2022, and with this, CJI Ramana will have an opportunity to recommend the names of around 13 Supreme Court judges during his tenure ending next year in August. The line of succession till 2027 will also see the youngest Justice D Y Chandrachud as the Chief Justice of India, who will head the institution for over two years. With the exception of unforeseen circumstances, such as death, early retirement or impeachment, the order of upcoming Chief Justices of India is all set. With the Law Commission of India’s recommendation that the Chief Justice of India should have a minimum tenure of two years in the apex court, an analysis of the future CJIs based on their seniority reveals that no judge would be able to stay there beyond a year and a half. Justice Dhananjaya Yeshwant Chandrachud is set to become the 50 th Chief Justice of India (CJI) in November 2022. Key facts • The current CJI Chief Justice of India U.U. Lalit nominated Justice DY Chandrachud as his successor during a meeting involving other judges of the Supreme Court held on October 11, 2022. • The CJI’s recommendation to the government will kick off the process for the appointment of the 50 th Chief Justice of India. • If this appointment is approved by the Central Government, Justice DY Chandrachud would be the first second-generation Chief Justice of India. • Justice DY Chandrachud’s father – Justice YV Chandrachud – was the 16 th Chief Justice of India. • Justice YV Chandrachud became the CJI in 1978. He held this position for the longest tenure of seven years. His son, Justice DY Chandrachud, has been a Supreme Court Justice for two years – the longest in the recent past. • Justice YV Chandrachud sentenced Sanjay Gandhi to jail in a case concerning the film “Kissa Kursi Ka” – a political satire film that was banned during the time of National Emergency. • During his tenure as a SC judge, DY Chandrachud had overturned two of the judgements made by his father. Justice N.V. Ramana sworn in as 48th Chief Justice of India

Justice N.V. Ramana was on Saturday sworn in as the The ceremony to administer the oath of office, held as per COVID-19 protocol, was attended by Vice-President M. Venkaiah Naidu, Prime Minister Narendra Modi, Lok Sabha Speaker Om Birla and Law Minister Ravi Shankar Prasad, among others. Justice Ramana will have a tenure of one year and four months as CJI and will demit office on August 26, 2022. After Justice K. Subba Rao, Justice Ramana is the second CJI from Andhra Pradesh. He practised at the Andhra Pradesh High Court, Central and A.P. Administrative Tribunals and the Supreme Court before being appointed permanent Judge of the Andhra Pradesh High Court on June 27, 2000. He functioned as acting Chief Justice of Andhra Pradesh High Court between March 10 and May 20, 2013, and was elevated as the Chief Justice of Delhi High Court on September 2, 2013. He was appointed as a judge of the Supreme Court on February 17, 2014. Born to agriculturist parents in 1957, Justice Ramana was known for his activism regarding issues involving farmers and industrial workers. Before turning to legal practice, he was a journalist with a prominent Telugu newspaper to a first-generation lawyer. He was Additional Advocate General for Andhra Pradesh before being called to the State High Court Bench in 2001.
