Chief Justice Chandrachud brings his daughters to Supreme Court: What would it be like if we brought our children to workplaces sometimes?

Premium Chief Justice Chandrachud brings his daughters to Supreme Court: What would it be like if we brought our children to workplaces sometimes? The tenor of workplaces can only change if there’s a trickle-down effect from positions of authority, normalising work and home overlapping each other at certain moments, openly, without guilt Eons ago, when we were in middle school, a friend’s father once turned up for the annual parent-teachers’ meeting and waited outside a classroom meant for a lower standard for a bewildering half hour, before the teacher figured out his conundrum and directed him to his daughter’s actual classroom. Afterwards, for several years, at gatherings and birthday parties, it would be the cause of much hilarity — uncle turning up in Standard VI when we were already in Standard VIII. A jovial man, he’d play his part, throwing up his hands dramatically and saying, “I spend so much time in the office and you all look so young, how was I to know?” We laughed at the absurdity, but it was a justification we acknowledged: Work was serious business. It wasn’t a place that accommodated children. It’s a story we still return to at get-togethers and alumni meets, though the subtext now appears less funny. Irrespective of the many industries we find ourselves in, the conversation now veers towards how, if anything, workplaces prefer to invisibilise children — family photographs or a stray artwork by one’s child at the workstation, notwithstanding. Between schoo...

Who is Justice D Y Chandrachud?

Premium Justice Chandrachud: The boy from Bombay now set to take over as 50th CJI From Aadhaar to Ayodhya, from right to privacy as “intrinsic to human dignity” to reading down section 377 of the IPC, Justice D Y Chandrachud’s judgments have been keenly watched for the weight of his words. Ananthakrishnan G & Omkar Gokhale on the boy from Bombay who is now set to take over as the 50th CJI On October 16, 2019, when then Chief Justice of India Ranjan Gogoi read out the Justice Chandrachud’s judgments, whether dissenting or concurring, have aroused similar interest — from his historic dissent in the Aadhaar case, when he said that a person’s multiple identities can’t be reduced to a 12-digit number; the soaring rhetoric of the Bhima Koregaon case, when he was again the sole dissenting voice as he said “dissent is a symbol of a vibrant democracy”; to the Hadiya case, when he held that a person’s right to choose a religion and marry was an intrinsic part of her meaningful existence. If the Aadhaar, right to privacy and Bhima Koregaon cases saw him being hailed as a liberal and progressive voice in the apex court, his stand in the Ayodhya case and Arnab Goswami case saw him being cheered on the other side. Don't miss | With Dhananjaya Yashwant Chandrachud set to take over as the 50th Chief Justice of India, it’s this ability to not be slotted in an ideological bracket — and to keep his critics and backers guessing — that will make his two-year term one of the most keenly watched...

Man is not owner of wife’s sexuality: Justice Chandrachud

Justice D.Y. Chandrachud held that a married woman can make her own sexual choices. By marrying, she has not consented to refrain from sexual relations outside marriage without the permission of her husband. A husband is not the owner of his wife’s sexuality. To be human involves the ability to fulfil sexual desires in the pursuit of happiness, Justice Chandrachud said. Human sexuality is an essential aspect of identity. Choices in matters of sexuality are reflective of the human desire for expression. Sexuality cannot be construed purely as a physiological attribute. It links up with the human desire to be intimate with a person of one’s choice. Sharing of physical intimacy is a reflection of choice. Autonomy in matters of sexuality is intrinsic to a dignified human existence. Human dignity both recognises and protects the autonomy of the individual in making sexual choices, Justice Chandrachud held. Section 497 denuded woman of the ability to make fundamental choices by postulating that it is only the man in a marital relationship who can consent to his spouse having sexual intercourse with another. Far from being an equal partner in an equal relationship, Section 497 subjugated a married woman entirely to the will of her spouse, he wrote. “The ability to make choices within marriage and on every aspect concerning it is a facet of human liberty and dignity which the Constitution protects,” Justice Chandrachud observed. In criminalising adultery, the legislature has impos...

The legend of Mumbai's 'Danny' Chandrachud

Old friends of Chief Justice of India Dhananjaya Y. Chandrachud call him ‘Danny’, a nickname given to him by one of his teachers at Mumbai’s 162-year-old Cathedral School, which counts Salman Rushdie and Zulfikar Ali Bhutto as ex-students. His parents, former CJI Yashwant Chandrachud and classical singer Prabha Chandrachud, call him ‘Dhanu’. In Bambaiya lingo, he is known as ‘genius aadmi’. Those who have been following his career say in chorus with undisguised pride, “Danny is the CJI India needs now!” The CJI’s colleagues credit Mumbai a great deal for “shaping” him as a forward-thinking liberal. Between November 9, 2022, when he took over as CJI, and December 16, as many as 6,844 cases have been wrapped up. As he stated recently, “No case is small or big enough for the court.” Applause! At a recent high-profile wedding reception in Mumbai, which saw India’s legal eagles in attendance, the buzz was that the CJI himself would show up. I kept my eyes peeled for a sighting in the 1,000-strong crowd. I have long admired the learned judge for his bold views on contentious issues. PTI An “accidental lawyer” who loves cricket and music, Chandrachud, 63, is known for his dry wit and quiet put-downs. I love one particular anecdote: when an advocate asked for a date after January 13, the CJI joked: “Is it an auspicious date suggested by an astrologer?” The advocate confessed it was his wife’s birthday. The CJI responded, “Very valid reason….”, and a new date was promptly fixed. Ch...
