Rahul Gandhi, Siddaramaiah, DK Shivakumar summoned in defamation case

By Press Trust of India: The BJP has filed a defamation complaint against Congress leader Rahul Gandhi, Chief Minister Siddaramaiah, Deputy Chief Minister D K Shivakumar, and Karnataka Pradesh Congress Committee (KPCC), before the Additional Chief Metropolitan Magistrate Court. The special court exclusively to deal with criminal cases related to elected former and sitting MPs/MLAs has taken cognisance of the offences under Sections 499 (defamation) and 500 (punishment for defamation) of the Indian Penal Code and posted the case for recording the sworn statement on July 27. The private complaint alleging false claims in advertisements tarnishing the image of the BJP was filed by the party's state secretary S Keshavaprasad on May 9. According to the complaint, the advertisement released by the KPCC in major newspapers on May 5, 2023 in the run-up to the Assembly election claiming that the then incumbent BJP government indulged in "40 per cent corruption" and had looted Rs 1.5 lakh crore in the previous four years was "baseless, prejudiced and defamatory". BENGALURU: In a big relief for deputy chief minister DK Shivakumar, the high court on Monday granted an interim stay on consent granted by the government to the CBI to proceed against him in a disproportionate assets case. A division bench headed by Chief Justice Prasanna B Varale passed the order after hearing a writ appeal filed by Shivakumar, also state Congress president. In April this year, a single bench had dismissed a petition filed by Shivakumar challenging a September 25, 2019, order issued by the then BS Yediyurappa government. The stay regrading an FIR registered by CBI on October 3, 2020, in relation to consent given by the government is continuing as the FIR has been challenged in a separate petition and a verdict is pending. Shivakumar argued that the decision of a co-ordinate bench in dismissing a petition filed by Shashikumar Shivanna, a close relative of his, challenging the same consent order will not have any bearing upon him as he (Shashi Kumar) was a HAL employee. It may be recalled that while dismissing the petition filed by Shivanna, a co-ordinate bench of the high court had observed that when a state government accords consent for a probe by CBI under the Delhi Special Police Establishment Act,1946, it is only an administrative order and does not require enormous rejigging. It was also pointed out that being a central government employee, Shashikumar had no locus standi in the issue.
