Eknath Shinde faction gets Shiv Sena name, symbol

The Election Commission of India on Friday allotted the name ‘Shiv Sena’ and the party’s bow and arrow symbol to the Eknath Shinde faction in effect recognising it as the original party founded by Balasaheb Thackerey. The Commission said that it had based its decision on a “test on majority” as the group of MLAs supporting the Eknath Shinde group had got nearly 76% of the votes polled for the 55 winning Shiv Sena candidates in the 2019 Maharashtra Assembly Elections, while the Uddhav Thackeray faction got only 23.5% of votes. Victory of democracy, says Eknath Shinde; democracy dead, declares Uddhav Thackeray “The party name Shiv Sena and the Party symbol Bow and Arrow will be retained by the petitioner (Eknath Shinde) faction,” the EC ruled in a detailed 78-page order. The two factions have been locked in a fight over the party’s name and symbol since last June when Mr. Shinde walked out of Maharashtra’s ruling Maha Vikas Aghadi alliance with 40 MLAs in a high-voltage revolt. Mr. Shinde then became the Chief Minister with the support of the BJP. Before the Election Commission, his faction has claimed the support of 40 of the Shiv Sena’s 56 MLAs and 13 of the 18 Members of the Lok Sabha. Thackeray-Shinde row: Supreme Court to decide later on referring pleas to 7-judge Bench In November 2022, the commission had frozen the bow and arrow symbol of the Shiv Sena and had allotted the ‘Two Swords and Shield symbol’ to the Eknath Shinde faction and the ‘flaming torch’ ( mashaal) s...

PM Modi came, he smiled, CM Eknath Shinde conquered

With the competitive celebration by the two Shiv Senas of Balasaheb Thackeray’s birth anniversary on Monday again underlining the unsettled matter of So, for some days now, what remains a matter of discussion is the warmth shown by Prime Minister Narendra Modi towards the Maharashtra Chief Minister during his recent visit to Mumbai – Modi’s first since the BJP manoeuvred the split in the Sena to form a government with the Shinde faction, six months ago. Modi’s special efforts to acknowledge Shinde were evident right at the airport when he landed, where he paused next to the CM to pat him on his shoulder. Later, after Shinde had spoken at the event that they addressed, the PM praised him for his speech, and mentioned the CM’s observation about how India was gaining global recognition. The two were in constant conversation on the stage, as well as when they travelled on the newly launched Metro line together. Deepak Kesarkar, a Shinde Sena leader and minister, pointed this out: “The PM not once but twice praised the Shinde-Fadnavis government in public!” The immediate goal of the all-is-well message was obviously the coming BMC polls. The Opposition has been claiming a rift in the alliance, particularly taking digs at Shinde’s “secondary” position to Deputy CM and BJP leader Devendra Fadnavis in the government. Apart from overtures towards Shinde, the PM came bearing mega infrastructure projects worth Rs 38,900 crore, which were inaugurated by him. Among those who have been ...

Eknath Shinde news: Eknath Shinde: Former auto driver and Shiv Sena street

Synopsis The four-time MLA, who held the urban development and PWD portfolios in the previous Maha Vikas Aghadi (MVA) government led by Uddhav Thackeray, never hid his humble origins. On the contrary, he made it a point to mention it to underscore how he has been indebted to the Shiv Sena and its founder, late Bal Thackeray for his rise in Maharashtra politics. Born on February 9, 1964, Shinde dropped out of college before completing graduation. After moving to Thane, he soon found his calling as one among thousands of Shiv Sena cadres who were ever-ready to hit the streets at the command of Bal Thackeray. Thackeray formed Shiv Sena in 1966 as a party fighting for the rights of the 'sons-of-the-soil' Marathi-speakers, and later aggressively championed the cause of 'Hindutva'. As Shinde joined the Sena in Thane, he found a mentor in local party stalwart Anand Dighe. He became Dighe's deputy and strengthened the party in Thane-Palghar region after Dighe's sudden death in 2001. The sitting MLA from Kopri-Pachpakhadi in Thane city, Shinde was once a quintessential Shiv Sena street-fighter. He faces dozens of criminal cases for charges such as 'voluntarily causing hurt by dangerous weapons' and rioting, registered during various party agitations. He became a corporator in the Thane Municipal Corporation in 1997 and won his maiden Assembly election in 2004. In 2005 he was made the Sena's Thane district chief. Currently he is in his fourth term as an MLA, while his son Dr Shri...

What a slap; Eknath Shinde should resign: Uddhav Sena leaders on SC verdict

Sanjay Raut, Priyanka Chaturvedi on Thursday interpreted the Uddhav Sena said the verdict is against the Shinde-Fadnavis government. But Supreme Court's 'Uddhav can't be reinstated' is a relief to the incumbent government. (Ishant) "As per the judgement today, The entire government of Shinde Fadnavis was formed on the basis of an illegal whip deciding who to vote for and a trust vote carried out on the orders of a biased Governor. What a slap on the face of this illegal cabinet," Uddhav Sena MP Priyanka Chaturvedi said. “The judgment without literally saying it has called the Maharashtra government illegal and unconstitutional! An unconstitutional call by governor for floor test and an illegal whip deciding the CM to be from his illegal faction,” Chaturvedi added. The Governor of Maharashtra should not allow this unconstitutional and illegal government to function or take any important decisions till the illegal whip’s decision to support change of government is withdrawn and the illegal faction is disqualified by speaker for indulging in immoral acts of betrayal to the state and its political party, the Sena MP added. "-The whip Bharat Gogawale appointed by Shinde judges as illegal- The Governor’s floor test decision was outside his jurisdiction and authority. Slap on the face of the unconstitutional and illegal government enjoying the perks of power minus accountability," Chaturvedi tweeted. 'Moral victory for Uddhav camp' The Supreme Court said the floor test order by t...

Relief for Shinde, Lessons for Uddhav: What Next in Maharashtra Post SC Verdict?

The apex court's refusal to restore status quo, came as a relief for Shinde, who himself was on the list of 16 MLAs facing disqualification for allegedly violating the tenth schedule of the Indian constitution. While a total of 40 MLAs had defected from the Shiv Sena, the disqualification was sought against the 16 MLAs who were the first ones to go incommunicado. As per the judgement, the speaker must decide disqualification petitions. The incumbent speaker of Maharashtra Assembly — Rahul Narwekar — is a member of the BJP and hence, there are almost negligible chances of him disqualifying these MLAs and disturb the numbers of the Shinde-Fadnavis government. While on the face of it, the judgement does give the Uddhav Thackeray camp a moral victory by ruling that the then Governor was not justified in calling upon Thackeray for a floor test, it does little to alter the power dynamics on ground. This, however, will be a big moral boost for the MVA alliance if they decide to contest the 2024 Lok Sabha and Assembly elections together. Reacting to the verdict, Thackeray said that the CM Shinde and deputy CM Fadnavis should resign if they have any morals left and should face elections. "If the current Maharashtra Chief Minister and deputy Chief Minister have any ethics, then they should resign," he said.

Eknath Shinde's job restored: Maha Guv did not act as per law, but can’t restore Thackeray govt, says SC

Maharashtra Political Crisis: In a major setback to Uddhav Thackeray and his team, the Supreme Court on Thursday said that current Maharashtra CM Eknath Shinde will get to keep his job, even though Maharashtra Governor did not act in accordance with law. The apex court held that the Maharashtra Speaker's decision to appoint Bharatshet Gogawale, who was backed by the Shinde faction, as the Whip of the Shiv Sena party was illegal, Live Law reported on Thursday. The five-judge Constitution Bench, comprising CJI Chandrachud and Justices M R Shah, Krishna Murari, Hima Kohli, and P S Narasimha, on Thursday said: 1. The governor had no objective material in calling for a floor test. "If the Speaker and the government circumvent the no-confidence motion, the Governor will be justified in calling for a floor test without the aid and advise of the council of ministers...The assembly was not in session when the Leader of Opposition Devendra Fadnavis wrote to the Government. The opposition parties did not issue any no-confidence motion. The Governor had no objective material to doubt the confidence of the Govt," he said. 2. A floor test cannot be used as a medium to resolve inter-party disputes or intra-party disputes, the bench said. "Even if it is assumed that the MLAs wanted to exit the govt, they constituted only a faction There is a marked difference between the party not supporting the government and the individuals not supporting it.
