Delhi Lieutenant Governor V K Saxena on Friday recommended a CBI probe into the Delhi Excise Policy 2021-22 over alleged violations of rules and procedural lapses. The LG has found "substantive indications" of "financial quid pro quo" at the "top political level" wherein the excise minister "took and got executed major decisions in violation of the statutory provisions" and notified the Excise Policy that had "huge financial implications". All 11 officers are part of the Delhi excise department. Three of them Arva Gopi Krishna, the then Commissioner (Excise), Anand Tiwari, the then Deputy Commissioner (Excise), and Pankaj Bhatnagar, Assistant Commissioner (Excise) figure in the CBI’s first information report as accused in the scam. Krishna and Tiwari were suspended by the Union home ministry on Monday. The FIR alleged that the liquor barons were in close contact with accused public servants and were regularly lining their pockets. The eight others suspended are assistant commissioners Narinder Singh and Neeraj Gupta, section officers Kuljeet Singh, Subhash Ranjan and Suman and dealing hands Satya Brat Bhargav, Sachin Solanki and Gaurav Mann. They have not been named in the case yet. The L-G had found serious lapses on the part of the officers in the implementation of the excise policy, including finalising the tender and extending benefits to select vendors. In a fresh trouble for the Arvind Kejriwal government, Delhi Lieutenant Governor VK Saxena has recommended a CBI probe into its Excise Policy, 2021-22, over alleged violations of rules and procedural lapses, officials said on Friday. The CBI inquiry was recommended on Delhi Chief Secretary's report filed earlier this month, showing prima facie violations of GNCTD Act 1991, Transaction of Business Rules (ToBR)-1993, Delhi Excise Act-2009 and Delhi Excise Rules-2010, they said. Apart from this there were also "deliberate and gross procedural lapses" to provide post tender "undue benefits to liquor licensees", said the officials. Excise policy: Delhi government sources refute chief secy report flagging violations

The CBI probe was recommended by Lieutenant Governor V K Saxena last month based on the Delhi chief secretary's report that had listed various instances of "violations of rules and procedural lapses" and "undue favour" to licensees in the implementation of the policy from November 2021. The CBI has filed an FIR against 13 persons and two companies, including Deputy Chief Minister and Excise Minister Manish Sisodia, in the matter. The policy was withdrawn by the government after Saxena recommended a CBI probe into it. The report had raised seven specific violations and lapses, including waiver of license fee worth Rs 144.36 crore of licensees due to the Covid pandemic, refund of Rs 30 crore earnest money deposit of a bidder for airport zone, reducing the number of dry days, and lack of coercive action on payment default. The Delhi government waived the licence fee as the licensees had approached court although there was no such specific provision for compensation in the tendered document, government sources said. The licensees had approached the government requesting waiver in the licence fee for the days of the lockdown that came soon after liquor shops opened from November 17. The Delhi excise department in a circular issued on Wednesday specified conditions for opening of liquor shops in 'non-conforming' areas that are largely unauthorised colonies. It stated that the Delhi Cabinet in its meeting on November 5 decided opening of liquor stores in these areas. The circular issued by the department said that applications for the grant of L-7V licence(authorising retail sale of Indian and foreign liquor) may be considered provided the 'non-conforming' area exists in that particular ward in which the licensee plans to open the store. The circular added that two vends may be permitted to be opened in wards which have 'non-conforming' areas. "The opening of two mandatory vends may be permitted based on an affidavit to be furnished by the L-7Z (meant for retail sale of Indian liquor) licensee that there is a 'non-conforming' area in the ward." "In case any municipal ward is found to be having a 'conforming' area, the L-7Z licensee shall be bound to shift his vend to a conforming area within 30 days of the issue of notice by the department," read the circular. The minimum carpet area of stores in these 'non-conforming' areas should be 500 square feet, it said.
