Lok Adalats not courts, no precedent value of settlement decrees, says SC

NEW DELHI: In an important judgment, the Noida authority had issued a notification in March 1983 for acquisition of land in villages situated in Tehsil Dadri for planned industrial development. Land owners were given compensation at the rate of Rs 20 per square yard in November 1984. None of the land owners questioned the rate of compensation and all accepted the amount due to them. One Fateh Mohammed filed an application seeking reference against the Award of November 28, 1984 and it was made over to a Lok Adalat, where Noida authority settled with him in 2016 and agreed to pay Rs The other landowners saw the opportunity and successfully pleaded before the Allahabad HC for grant of compensation at the rate of Rs 297 per square yard on the ground that Lok Adalat awarded decrees had precedential value. NOIDA challenged the HC order in SC. A bench of Justices K M Joseph and P S Narasimha framed the question, “Whether the Award passed by a Lok Adalat under Section 20 of the Writing the judgment, Justice Joseph disagreed with the HC view and said Lok Adalats do not employ any judicial scrutiny and under the legal services act only encourage the parties to settle amicably. BSES organises ‘hybrid’ Lok Adalat in Delhi

By Express News Service NEW DELHI: The BSES is organising first-of-its-kind hybrid Lok Adalat in East and Central Delhi for amicable and on-the-spot settlement of power-theft cases. For this the power discom Yamuna Power Limited (BYPL) has partnered with the Delhi State Legal Services Authority (DSLSA). It is being organised on January 17, 2021 between 10 am and 3 pm. To participate in the special ‘hybrid’ Lok Adalat, all consumers will have to pre-register themselves at the local BYPL customer care centre, nearest to their place of residence. Consumers will be allocated a specific time-slot. On the day of the Lok Adalat, they will have to reach the BYPL Circle Office at the allocated time, either in person or through their authorised representatives. At the venue, all the cases will be taken-up at the virtual courts, where all the participants, including the Judges and the Court officials, will join virtually through video conferencing. Hybrid Adalat is a blend of online and offline participation to ensure safety of the consumers and officials, seamless connectivity and faster resolution of the cases. In a first,govt bank opts for Lok Adalat,settles huge backlog

Seventy-year-old Jaspal Singh had been struggling for over a year to get back his property in Defence Colony that he had mortgaged against a loan taken from a bank. On Sunday,however,it took him just half an hour to get it back after a court settled his case in the Lok Adalat at the Patiala House courts complex. More banks have now joined hands with the Delhi Legal Services Authority (DLSA) now to bring down the ever-mounting judicial backlog. After the success of the recent Lok Adalat held in collaboration with ICICI Bank,Canara Bank,which is a public sector bank,apart from Axis Bank participated in today’s Mega Lok Adalat that saw the disposal of almost ninety per cent of their cases. The Lok Adalat was held to settle recovery cases pertaining to personal loans,mortgage loans and education loans of the two banks. Unlike previous instances,all cases taken up by the DLSA were referred by the banks while in the pre-litigative stage,to prevent the fresh inflow of cases in courts. The two courts assigned by the DLSA for the purpose,recovered a sum of over Rs 45 lakh by settling 32 cases,of which Rs 31,73,783 was obtained from the court of the presiding officer Sanjay Sharma. “Once again,the Lok Adalats got a favourable response from both the parties and we were successful in settling most cases,” said Sanjay Sharma,project officer of DLSA.
