NASHIK: A sessions court here on Wednesday convicted and sentenced Achalpur MLA Omprakash alias Bachchu Baburao Kadu to one-year imprisonment each on two charges of assault on a public servant and intentional insult on July 24, 2017 during a meeting at a hall adjacent to the Nashik municipal commissioner's office. While the sentences are to run concurrently, Kadu's lawyers moved a bail application soon after the sentencing and the court granted bail to the MLA to enable him to move an appeal in a higher court. Sessions judge V S Kulkarni read out the operative part of his ruling and a full text of the judgment will be released in due course of time. It was not uploaded on the district court's website till late Wednesday evening. Mumbai: The Maharashtra assembly's resolution to suspend 12 BJP MLAs for a year for alleged unruly behaviour has been set aside by the Supreme Court. "Suspending the MLAs beyond the sessions is unconstitutional and illegal," the Supreme Court said today. While the rules say suspension can be for the session, the 12 MLAs were suspended for a year beyond the session. The 12 MLAs are Sanjay Kute, Ashish Shelar, Abhimanyu Pawar, Girish Mahajan, Atul Bhatkhalkar, Parag Alavani, Harish Pimpale, Yogesh Sagar, Jay Kumar Rawat, Narayan Kuche, Ram Satpute and Bunty Bhangdia. The motion to suspend the MLAs was moved by state Parliamentary Affairs Minister Anil Parab and passed by a voice vote. Leader of Opposition Devendra Fadnavis had termed the allegation as false, and said Mr Jadhav's account of the incident was "one-sided". "This is a false allegation and an attempt to reduce the numbers of opposition benches, because we exposed the government's falsehood on the OBC (Other Backward Classes) quota in local bodies," Mr Fadnavis had said, adding that BJP members had not abused the presiding officer.

Ruling that the Maharashtra Assembly’s July 5, 2021 resolution suspending 12 BJP MLAs for one year following alleged misbehaviour in the House was “unconstitutional, substantively illegal and irrational”, the Supreme Court said Friday that the legislators could not have been suspended beyond the tenure of that session. The BJP hailed the ruling, saying it is a “vindication” of its stand and “a huge setback” for the ruling Maha Vikas Aghadi coalition in the state. The bench of Justices A M Khanwilkar, Dinesh Maheshwari and C T Ravikumar, ruling on a plea by the suspended MLAs, declared the resolution “non est in the eyes of law” and “ineffective in law, insofar as the period beyond the remainder of the stated Session in which the resolution came to be passed”. “Suffice it to observe that one-year suspension is worse than ‘expulsion’, ‘disqualification’ or ‘resignation’ — insofar as the right of the constituency to be represented before the House/Assembly is concerned. In that, long suspension is bound to affect the rights harsher than expulsion wherein a mid-term election is held within the specified time in terms of Section 151A of the 1951 Act, not later than six months. Former Maharashtra MLA Ashish Deshmukh on May 25 criticised the Congress for expelling him and said the action showed the party's state unit was in the hands of wrong people. The State Congress recently expelled Mr. Deshmukh from the party for six years over his public statements against the party leadership. The order of expulsion was issued to Mr. Deshmukh by senior Congress leader and Former Chief Minister Prithviraj Chavan, Chairperson of the State Congress Disciplinary Committee, through a letter dated May 22.
