On November 9, the President of India will While the debate relating to the appropriate procedure for the appointment of judges continues to occupy the political space, there are also age-old issues relating to the role of the judiciary in a democracy. Recently, Union Minister of Law and Justice Kiren Rijiju observed, “Should the judiciary run the country or should the elected government?… Now if the judiciary starts framing the rules, if they start deciding where the road is to be built, if the judiciary gets into the service rules, what is the government for…” The incoming CJI will have several demands on his time and the institutional and social expectations on the judiciary are profound. I believe that there are five critical aspects of the justice delivery mechanism that need attention. The first is the appointment of judges. All organisations and institutions are fundamentally dependent on their ability to have outstanding people, with competence, integrity and independence, appointed to them. To appoint the right people to the Supreme Court and the high courts requires enormous effort and identification of talent from the legal profession and academia. Who is SA Bobde? New CJI: Meet Justice SA Bobde, the Next Chief Justice of India

Justice Sharad Arvind Bobde was sworn in as India’s 47th Chief Justice by President Ram Nath Kovind on Monday, 18 November. In accordance with convention, the incumbent CJI Ranjan Gogoi, who retires on 17 November, had recommended Justice Bobde – who is next in seniority – as his successor, in a letter to Ministry of Law and Justice. The President signed the warrant for his appointment on 29 October. Justice Bobde takes up the office soon after being part of the bench that finally ended the Ayodhya title dispute. He will continue as the 47th CJI till 23 April 2021, when he retires. Born on 24 April 1956 in Nagpur, Maharashtra into a family of lawyers (his grandfather, father and brother are all distinguished advocates), Justice Bobde secured his BA and LLB Degrees from Nagpur University, after which he enrolled with the Bar Council of Maharashtra in 1978. Justice SA Bobde practised at the Nagpur Bench of Bombay High Court with appearances before the principal seat in Bombay and before the Supreme Court of India, and became senior advocate in 1998. On 29 March 2000, he was appointed as a judge of the Bombay High Court. After 12 years on the bench in his home state, he became Chief Justice of the Madhya Pradesh High Court on 16 October 2012. New CJI reports detail factors impacting community supervision success in four states and offer strategies for nationwide improvement

BOSTON – The Crime and Justice Institute, with support from Arnold Ventures, today Community supervision, such as probation and parole, is often viewed as an alternative to incarceration, but many states are struggling with increasing or stagnant revocation rates, which frequently result in people being incarcerated. Of the 1.8 million individuals who exit probation or parole each year, almost half do not successfully complete supervision, with 211,000 people returning to prison or jail. In 2019, CJI, with support from Arnold Ventures, began a comprehensive assessment of sentencing and community supervision practices in four states: Colorado, Florida, Mississippi, and Montana. The goal of this effort was to equip state leaders with the information necessary to adopt and expand evidence-based supervision practices demonstrated to increase public safety and increase the successful transition to communities. Over 18 months, CJI reviewed a decade’s worth of data from five supervision agencies in the four states, interviewed dozens of stakeholders, reviewed statute and policy, conducted focus groups and surveys to gain input from more than 1,300 agency staff, and reviewed nearly 900 supervision case files.
