Retired SC judge Arun Kumar Mishra appointed as NHRC chairperson; opposition sees red

On Tuesday, President Ram Nath Kovind appointed retired SC judge Arun Kumar Mishra as the chairperson of the National Human Rights Commission based on the recommendation of a selection panel. The high-powered committee comprised of Prime Minister Narendra Modi, Union Home Minister Amit Shah, Rajya Sabha Deputy Chairman Harivansh, Lok Sabha Speaker Om Birla, and Rajya Sabha Leader of Opposition Mallikarjun Kharge. While reportedly the names of three ex-Chief Justices of India were among the shortlisted candidates, Mishra was eventually chosen. However, it is pertinent to note that Kharge dissociated himself from the process of selection of the new chairperson and members of the NHRC. During the meeting of the selection panel at the PM's residence on Monday evening, the veteran Congress leader pitched that at least one person belonging to the Scheduled Castes, Scheduled Tribes and Minorities should be recommended either as a member or the chairperson of the body. Interestingly, Mishra who had retired on September 3, 2020, will become the first non-CJI to take charge as the NHRC chief. This has become possible owing to an amendment to the Protection of Human Rights Act, 1993 passed by the Parliament in 2019 whereby both a former CJI or an apex court judge was made eligible for this post. The correct option is A 1 and 2 only In the Original Protection of Human Rights Act 1993, only Retired Chief Justice of India could be appointed as NHRC Chairperson. In 2019, an amendment was made to this and now a person who has been a Judge of the Supreme Court is also eligible to be appointed as Chairperson of the Commission in addition to a person who has been the Chief Justice of India.

Tribune News Service New Delhi, June 1 Prime Minister Narendra Modi-led five member selection committee has recommended the name of former Supreme Court Judge Arun Kumar Mishra as the next chairperson of the National Human Rights Commission (NHRC). However, Leader of Opposition in Rajya Sabha Mallikarjun Kharge dissented to the decision questioning the absence of the names of eligible candidates from marginalised communities in short list of 12 candidates. This is the first time in the NHRC’s 27 years that the commission will be headed by a former SC judge and not a former Chief Justice of India. The NDA government had in 2019 amended the Protection of Human Rights Act, which earlier mandated that the NHRC chief should be a former CJI. The law was changed to allow appointment of a former SC judge as the commission chief. Former SC Judge Arun Mishra had recently made news for praising the PM as an “internationally acclaimed visionary who could think globally and act locally” and a “versatile genius”. He was selected from a list of 12. He retired from the apex court in September 2020. The final orders on the appointment of the NHRC chairman will come from President Ram Nath Kovind on the recommendation of the selection committee.

New Delhi: Amid the second wave of Covid-19 affecting the labourers and migrant workers, the National Human Rights Commission will welcome its new chariman Justice Arun Kumar Mishra (Retd), who will assume charge on Wednesday. It is for the first time in its 27-year history that the government will be formally appointing someone other than a former chief justice of India. Justice Arun Kumar Mishra (Retd), who will take charge as the new chairman after the position has been lying vacant since former CJI H.L. Dattu retired in December 2020. NHRC delegation tours various manpower sourcing countries

Doha, Qatar: A delegation from the National Human Rights Committee (NHRC) headed by NHRC Deputy Chairman H E Dr. Mohammed bin Saif Al Kuwari toured a number of labour-exporting countries, in which the delegation met with the local human rights commissions (HRC). The tour came within the framework of enhancing cooperation and the exchange of expertise between NHRC and HRCs abroad regarding the protection and promotion of workers’ rights. During his meeting with the Chairperson of the National Human Rights Commission (NHRC) of India Arun Kumar Mishra in the Indian capital, NHRC Deputy Chairman affirmed that NHRC considers the protection of workers’ rights as one of its priorities and focus of attention, given that they are among the groups most deserving of care. His Excellency also noted the great role skilled workers play in development, as one of the most important pillars in the achievement of sustainable development goals. Al Kuwari listened to a detailed explanation on the work and role of the NHRC of India and its efforts to monitor and train staff for the goal of providing distinguished work. The two sides agreed to sign a Memorandum of Understanding (MoU) in order to frame joint cooperation in supporting and promoting human and workers’ rights between both countries. NHRC Chairman, MEPs discuss human rights system in Qatar

Doha: Chairman of the National Human Rights Committee (NHRC) H E Dr. Ali bin Smaikh Al Marri met yesterday with a delegation of the Members of the European Parliament (MEPs), headed by Chairperson of the Sports Committee H E Marc Tarabella, who is currently visiting the country, at the headquarters of the Committee. Dr. Ali bin Smaikh Al Marri extended thanks to the delegation for accepting NHRC’s invitation to visit the State of Qatar, commending the strong partnership between NHRC and the European Parliament, as the NHRC in Qatar is the first of its kind to sign a memorandum of understanding with the European Parliament. Al Marri affirmed the Committee’s continued efforts to strengthen the human rights system in Qatar, in addition to implementing the national human rights strategy and sustaining dialogue between NHRC and the European Parliament in all aspects related to human rights. He provided the delegation with an overview of the most important developments in the field of human rights, especially workers’ rights, in terms of legislation and mechanisms introduced by the State.
