Mukul Rohatgi set to return as Attorney General of India

By Nalini Sharma: Senior advocate Mukul Rohatgi is all set to make a comeback as the Attorney General of India, sources said. He is likely to assume office on October 1, after current AG KK Venugopal steps down. The Attorney General is the top law officer of the country and the Centre’s top lawyer before the Supreme Court of India. This will be Mukul Rohatgi's second stint as AG. Rohatgi, 67, took over as the Attorney General for the first three years of the BJP-led NDA government, from 2014 to 2017. In June 2017, he resigned from the post of the AG citing personal reasons. He resumed his private practice immediately after. Subsequent to Rohatgi’s resignation, senior advocate and veteran legal luminary KK Venugopal was appointed as the Attorney General from July 1, 2017. Venugopal expressed his inclination not to continue earlier this year after defending the Centre in the Supreme Court for over five years and receiving two extensions at the end of his three-year tenure. In June this year, the Centre had requested Venugopal to extend his tenure for an additional three months to give them time to find a suitable person to replace him, to which he had agreed. Venugopal’s tenure officially ends at the end of this month and Rohatgi is expected to assume office from October 1. Ministerial sources and those close to Rohatgi suggest that a meeting was held last week to discuss the matter, following which Rohatgi has given his assent to the post.

Articles 76 and 78 deal with the Attorney General of India. The Attorney General of India is the highest law officer of the country. He is responsible to assist the government in all its legal matters. The President appoints the Attorney General (AG). The person who is appointed should be qualified to be appointed a judge of the Supreme Court. That means, he should be a judge of some high court for five years or an advocate of some high court for ten years. The Attorney General of India is appointed by the President of India under Article 76(1) of the Constitution and holds office during the pleasure of the President. He must be a person qualified to be appointed as a Judge of the Supreme Court. The 15th and current Attorney General is K. K. Venugopal.He will be succeeded by R Venkataramani as the 16th Attorney General of India on 1st October 2022. Articles 76 and 78 deal with the Attorney General of India.
