The rejection of the plea means Gandhi, former leader of the Congress party and the most recognisable face of India’s political opposition, is disqualified from office and there will now be a byelection in his Kerala constituency. Gandhi’s lawyers said they would challenge the ruling in a higher court. “We are going to challenge the decision in Gujarat high court tomorrow. We have full faith that the judiciary will uphold justice and save the democracy,” said Naishadh Desai. In March, Gandhi was convicted of defamation by a court in Gujarat over a 2019 speech made on the campaign trail in which he linked the prime minister, Purnesh Modi, a legislator in Modi’s home state of Gujarat, subsequently filed a case in the courts alleging that all those named Modi in the country had been offended and defamed by Gandhi’s comment. Image Source : PTI Congress leader Rahul Gandhi The Bombay High Court on Monday extended the interim relief granted to Congress leader Rahul Gandhi from appearance before a court in a defamation complaint on his alleged remarks against Prime Minister Narendra Modi in 2018 till August 2. The complainant, who claims to be a BJP worker, had alleged that Gandhi's "commander-in-thief" remark in the context of the Rafale fighter jet deal amounted to defamation. A single bench of Justice S V Kotwal adjourned the hearing on the plea filed by Gandhi challenging the summons issued to him by the local court in 2021 after the complainant's lawyer sought time. "The interim relief granted earlier to continue till August 2," Justice Kotwal said. Earlier, Gandhi was directed by the local court to appear before it in November 2021 in a defamation complaint filed by Mahesh Shrishrimal. Gandhi then approached the HC challenging the summons issued to him. New Delhi/Surat: Congress leader Rahul Gandhi was found guilty and sentenced to two years in prison on Thursday in a 2019 criminal defamation case over his remarks about Prime Minister Narendra Modi's surname by a court in Gujarat's Surat. However, he was granted bail and his sentence was suspended for 30 days to let him appeal the decision. The case was filed against Mr Gandhi by BJP MLA and former Gujarat minister Purnesh Modi for saying "How come all thieves have the common surname Modi?" The Lok Sabha MP from Wayanad made the remarks while addressing a rally in Karnataka ahead of the 2019 Lok Sabha elections, targetting PM Modi over his last name which he shares with fugitive businessmen Nirav Modi and Lalit Modi. NEW DELHI — India’s parliament on Friday disqualified the leader of the main opposition Congress party, Rahul Gandhi, a day after a court found him guilty of defamation over his remarks about Prime Minister Gandhi “stands disqualified from the membership of Lok Sabha,” parliament said, referring to the lower house of parliament. Congress members held protests in some parts of the country on Friday against Gandhi’s conviction and two-year-old jail sentence.
