Premium 10 crore investors of 4 Sahara group’s cooperative societies to get back money within 9 months: Government In a statement, the Ministry of Cooperation said the Supreme Court, while giving a historic decision, ordered to return the deposits of about 10 crore investors of 4 cooperative societies of Sahara group from the Sahara-SEBI refund account. The government on Wednesday said money will be returned to 10 crore investors of 4 cooperative societies of Sahara group within 9 months following a Supreme Court order directing transfer of Rs 5,000 crore from Sahara-SEBI refund account to the Central Registrar. Earlier in the day, the Supreme Court allowed a plea by the Centre seeking allocation of Rs 5,000 crore, out of Rs 24,000 crore deposited by the Sahara group with market regulator Sebi, to repay depositors of the cooperative societies. The direction came on an application filed by the Centre in a PIL by a person, named Pinak Pani Mohanty, who sought a direction to pay the amount to the depositors who invested in several chit fund companies and Sahara credit firms. A bench of Justices M R Shah and C T Ravikumar said the amount shall be disbursed to depositors duped by the Sahara group of cooperative societies. The entire process will be monitored by former apex court judge Justice R Subhash Reddy, the bench said. The court of Central Registrar has asked the Sahara Credit Cooperative Society to submit the detail of assets and liabilities of the society along with a credible plan for returning money to depositors within a period of 90 days. The hearing in the court of Central Registrar of Cooperative Societies which took place through Video Conferencing recently asked the counsel of Sahara to make a complete assessment of all amounts due to the depositors up to 31.3.2021. The order sheet reads, “Society shall place an accounting team at the disposal of learned counsel for making a complete assessment of all amounts due to the depositors up to 31.3.2021. The current realisation value of all the investments made shall also be assessed and presented along with the aforementioned details. It may also be examined as to how much can be the income from interest dividend from the investments of the society in case liquidation of assets is not possible in the short term”, its reads. “On the basis of the complete financial assessment of the society, learned counsel of the society shall also present a credible working plan for the society. Learned counsel for the society is permitted to submit an interim report, in case the full report is not ready at the next date of hearing but in any case, the report must be submitted within a period of 90 days from today”, according to the order sheet. Since the court order is clear on restraining these societies, it needed larger publicity to make general public aware,” said an official of the Co-operative Ministry. Normally, ministry does not issue such a press release after a court Order. A Delhi High Court Bench of Justice Vipin Sanghi and Justice Navin Chawla on March 22 had in an order directed “the petitioners not to collect any further deposits.” The Bench also directed the Central Registrar to pass orders directing the petitioners to refund the amounts to such members/investors/depositors whose amounts are found to have become due and payable, after examining their claims.
