Bombay Court grants bail to Sanjay Raut and Pravin Raut; Twin bail conditions u/S 45 PMLA satisfied

City Sessions Court, Mumbai: In a bail application filed by Pravin Raut (A3) and Sanjay Raut (A5) against arrest made by Directorate of Enforcement (ED) due to allegations relating to selling free sale component, generating proceeds of crime and laundering of about Rs. 95 Cr./ Rs. 100 Cr./ Rs. 112 Cr., M.G. Deshpande, J., granted bail and held that both accused are arrested illegally and are entitled to parity in view of disparity made by the ED in not arresting the main accused persons Rakesh (A1), Sarang (A2), their HDIL, MHADA and Government Officials/staff responsible for misdeeds of Rakesh and Sarang (A1 and A2) at the relevant time in 2006-2018. Pravin Raut prayed for grant of bail contending his innocence and false implication whereas ED strongly opposed the application alleging his active involvement in generation, placement, layering and integration of proceeds of crime (POC), amounting to a serious offence of money laundering. Sanjay Raut prayed for grant of bail on the same ground and ED opposed the application alleging that Sanjay Raut is involved in the crime right from the beginning in the process of generation, placement, layering and integration of the proceeds of crime and thus committed serious offence of Money Laundering under Sec. On perusal of documents placed before the Court, it was noted that Pravin Raut was arrested based on charges of civil nature and Sanjay Raut was arrested for no credible reasons to be seen. This truth is glaring. The Court is ...

Money laundering case: Shiv Sena MP Sanjay Raut secures bail

Mumbai: Shiv Sena (Uddhav Balasaheb Thackeray) Rajya Sabha MP Sanjay Raut walked out of Mumbai's Arthur Road jail on Wednesday evening, hours after a special court granted him bail in a money laundering case. He was arrested on August 1 by the Enforcement Directorate (ED) in connection with the money laundering case related to a housing project in suburban Goregaon. At around 5 pm, Raut's legal team dropped his bail order into the Arthur Road jail box and at about 6.50 pm, the Shiv Sena (UBT) leader stepped out of the prison, where he had spent more than three months. A large number of supporters of the Rajya Sabha member, who had assembled outside the jail, burst into celebration as soon as he walked out of the jail and raised slogans hailing him. Firecrackers were set off near the jail in central Mumbai by Raut's supporters. The arrest of Shiv Sena MP Sanjay Raut in a money laundering case by the Enforcement Directorate (ED) was illegal and a "witch-hunt, a special court here said on Wednesday while granting him bail in the Patra Chawl redevelopment matter. It also questioned why the main accused in the case, Rakesh and Sarang Wadhawan of real estate firm HDIL, were never arrested by the ED. Further, the reason the agency did not arrest concerned officials of MHADA and other government departments was "nothing, but conveying a message to then Union agriculture minister and then (Maharashtra) chief minister, creating a fear psyche in their mind that they are the next in t...

After 100 days in jail, Sena MP Sanjay Raut gets bail; court slams ED for arresting him for no reason

At 6.50 pm, 61-year-old Sanjay Raut stepped out of the prison. Uddhav Thackeray described him as a "fighter who never succumbed to pressure". "Tiger is back," said Sushma Andhare, spokesperson of the Uddhav Thackeray-led Shiv Sena faction. "I'm thankful to the court," a visibly emotional Sanjay Raut told the special judge when the bail order was announced. In the detailed order, the court said Sanjay Raut's arrest was “illegal” and a "witch-hunt”. The reason the agency did not arrest concerned officials of MHADA and other government departments was "nothing, but conveying a message to then Union agriculture minister and then (Maharashtra) chief minister, creating a fear psyche in their mind that they are the next in this queue," the judge said without naming the politicians in question. As per the charge sheet, meetings related to the redevelopment of Patra Chawl had been attended by Maharashtra Housing and Area Development Authority (MHADA) officials, Sanjay Raut as well as "then Union agriculture minister and chief minister" in 2006-07. It was an “astonishing admitted fact that main accused Rakesh and Sarang Wadhawan of HDIL, who had not only generated over Rs 1,000 crore, but also allegedly placed, layered and integrated the same, were never arrested by the ED," the court further said. "Basically, there was no reason nor any occasion to arrest both of them (Sanjay Raut and co-accused Pravin Raut)....for the allegations which are basically nothing but a civil dispute," t...

Shiv Sena leader Sanjay Raut gets bail in money laundering case

Image Source : PTI Shiv Sena leader was arrested in July Sanjay Raut gets bail: Shiv Sena MP Sanjay Raut on Wednesday was released from jail after spending more than 3 months in a money laundering case. A special court in Mumbai granted bail to Shiv Sena MP in a money laundering case pertaining to the Patra Chawl redevelopment project. The Additional Solicitor General, however, sought a stay on the execution of the bail order for a short period so that ED can appeal in a higher court against the order of Mumbai's PMLA court. After hearing arguments from both the sides, Mumbai's PMLA court rejected stay on the execution of bail order to Raut and co-accused Pravin Raut paving way for their release. Special Judge M G Deshpande, designated to hear cases pertaining to the Prevention of Money Laundering Act (PMLA), reserved the order last week after hearing arguments from both sides. The Enforcement Directorate (ED) arrested Rajya Sabha member Raut in July this year for his alleged role in financial irregularities in connection with the redevelopment of the Patra Chawl (row tenement) in suburban Goregaon. He is currently in judicial custody and lodged at the Arthur Road Jail in Mumbai. Raut had in his bail plea claimed the case against him was a perfect example of "abuse of power" and "political vendetta". The ED had opposed Raut's plea, saying he played a major role in the money laundering case related to the Patra Chawl redevelopment and acted "behind the curtains" to avoid th...

In a detailed 122-page order, special judge MG Deshpande said, "I hold that both accused are basically arrested illegally. The ED had pointed to statements of Sanjay Raut attending meetings concerning Patra Chawl. How...
