Supreme Court grants interim bail to Satyendar Jain on medical grounds

New Delhi: The Supreme Court on Friday granted interim bail to former Delhi minister Satyendar Jain, lodged in Tihar Jail in connection with a money laundering case, on medical grounds. The top court said that the interim bail order shall remain in operation till July 11 and the matter will be next heard on July 10 for further orders. Directing the release of Jain on bail, the court ruled that the AAP leader shall not make any statements to the media while on bail and also not leave Delhi during the bail period. A bench of Justices J K Maheshwari PS Narshima ordered Jain to not try to meet or influence witnesses of the case while on bail. This came a day after the Aam Aadmi Party (AAP) leader was admitted to the ICU of the LNJP hospital after he collapsed in the washroom of the Tihar Jail where he has been lodged for over a year in the money laundering case being investigated by the Enforcement Directorate. During the hearing earlier, Additional Solicitor General SV Raju opposed the bail on the grounds that Jain should be first examined by a committee of doctors from the AIIMS or the RML Hospital before his bail plea is considered. Raju argued that the ED has a problem with him being examined by the hospitals under the Delhi government as Jain earlier held the health and jail departments of the government led by Arvind Kejriwal and there is an apprehension that his medical records may be fudged. On April 6, the Delhi High Court had dismissed the bail plea of Jain in a money laundering case noting the witnesses' claim that he was the conceptualiser, initiator and fund provider in the alleged crime. The high court said the senior AAP leader was an influential person having the potential to tamper with evidence. The court“out-rightly” rejected Jain's submission that he was not found in physical possession of any property, saying for the offence of money laundering physical possession of the proceeds of crime is not necessary.

The Supreme Court on Friday granted interim bail until July 11 to former Delhi minister Satyendar Jain on medical grounds, turning down the Enforcement Directorate’s contention that the Aam Aadmi Party (AAP) leader‘s health status must be examined first by a panel of doctors from the All India Institute of Medical Sciences (AIIMS) in the national capital. Doctors at LNH, a Delhi government facility, said on Thursday that Jain was put on pain medicines for temporary relief and that they were formulating a treatment plan for him. Jain, who helmed several important portfolios as a minister, including health and prison, was arrested by ED last year. This is the first time that Jain will be released in over a year. By Srishti Ojha, Kanu Sarda: The Supreme Court on Friday granted interim bail to Delhi's former health minister and Aam Aadmi Party (AAP) leader Satyendar Jain in a money laundering case on medical grounds for six weeks. Satyendar Jain has been in Tihar jail since his arrest in connection with a money laundering case in May last year. The apex court said Satyendar Jain cannot leave Delhi without permission and cannot make any statement before the media. The Supreme Court allowed jailed Satyendar Jain to undergo treatment in the hospital of his choice, asking him to produce medical records. "We are inclined to consider interim bail on medical grounds and grant him six weeks to take medical treatment in private hospitals of his choice. He is being released on interim bail on medical grounds on conditions imposed by the trial court with the addition that he shall not influence or meet with any witnesses," the court said. Satyendar Jain was arrested by the Enforcement Directorate (ED) in a money laundering case on May 30. Assets worth Rs 4.81 crore linked to the Aam Aadmi Party minister's family were attached by the ED in a disproportionate assets case in April this year.

NEW DELHI: Delhi high court on Wednesday wrapped up proceedings on the bail plea of former minister Satyendar Jain in a money laundering case being probed by Enforcement Directorate (ED). Justice Dinesh Kumar Sharma reserved the verdict on the bail plea after hearing the arguments of the lawyers for both ED and the AAP leader, who has been in custody since May 30 last year. Jain earlier submitted that no case was made out against him, and he had fully cooperated in the investigation and there was no requirement to continue his incarceration after filing the chargesheet. He has challenged a trial court's November 17 order dismissing his bail plea on the ground that he was prima facie involved in concealing the proceeds of the crime. His co-accused, Vaibhav Jain and Ankush Jain, have also sought bail, which were heard jointly by the court. Opposing the three bail petitions, ED argued that the material on record showed that Jain was "in the thick of things" and his release would obstruct further investigation. It also referred to Jain's CCTV footage from Tihar Jail to show that he is an "influential person" who may influence witnesses and frustrate the proceedings. New Delhi: Supreme Court today granted six weeks interim bail to Delhi's former minister Satyendar Jain on medical grounds, just a day after he was admitted to an ICU. Jain was admitted to Delhi's Lok Nayak Jai Prakash Narayan (LNJP) Hospital after he collapsed in a bathroom of Tihar Jail due to dizziness. This was the second time in a week that Jain had to be taken to a hospital for medical attention. He has challenged Delhi High Court order dismissing his bail plea in the money laundering case against him. Notably, Jain was arrested by the Enforcement Directorate (ED) in connection with a money laundering case on May 31, 2022. The Delhi High Court had dismissed Jain's bail plea in April this year, stating that he may tamper with evidence as he is an influential person. Jain had been arrested last year by the Enforcement Directorate on the accusation of having laundered money through four companies allegedly linked to him. Satyendar Jain has earlier submitted that no case was made out against him and he has fully cooperated in the investigation and there was no requirement to continue his incarceration after filing of charge sheet. The ED had arrested Satyendar Jain in the money laundering case based on a CBI FIR registered against him in 2017 under the Prevention of Corruption Act. He was granted regular bail by a trial court on September 6, 2019, in the case registered by the CBI.
