The Supreme Court seems to be the last hope of team Uddhav Thackeray which has not only lost the Shiv Sena’s name and ‘bow and arrow’ symbol but also the party’s Parliamentary office. The top court will today hear the petition filed by former Maharashtra CM Thackeray challenging the decision of the Election Commission of India (ECI) to recognise the Eknath Shinde-led faction as the real Shiv Sena. The apex court listed the matter for hearing at 3:30 pm on Wednesday. Meanwhile, following the EC’s decision to give the Shiv Sena name and symbol to Eknath Shinde, a national executive meeting of the party was “Is the election commission taking the decision? Or is someone else dictating it? There is a bigger power behind this election commission decision. That possibility can’t be denied. Something like this has never happened. The entire party has been taken away. What has happened is completely wrong. Those who have done this, people will teach them a lesson,” NCP Chief Sharad Pawar Union minister Anurag Thakur has said the Election Commission’s decision to recognise the Eknath Shinde-led faction as the real Shiv Sena has made things “crystal clear” and former Maharashtra chief minister Uddhav Thackeray should now understand who actually has the support of party workers. NEW DELHI: The Supreme Court on Thursday said it would pass orders on Monday on whether to refer to a five-judge bench the constitutional questions relating to the issue of disqualification of MLAs, raised by warring factions of A bench of Chief Justice N V Ramana and Justice Krishna Murari and Hima Kohli, which on Wednesday had perused questions framed by the Thackeray faction and heard senior advocates Kapil Sibal and A M Singhvi on Wednesday, discussed the issues framed afresh by the Shinde faction’s lawyer Harish Salve. But the main apprehension of Sibal and Singhvi was the EC going ahead with the petition filed by the Shinde faction seeking recognition as the original party and laying claim on its symbol ahead of the BMC polls. “If the EC decides the symbol issue ahead of BMC polls, it will have grave consequences. Rebellion by 40 MLAs in a legislature party is one thing, but the political party which encompasses members down to taluka level is much larger and the claim cannot be decided on the basis of garnering majority support within the legislature party,” Sibal said.
