After Ram Jethmalani, Subramanian Swamy to argue for Asaram

Living up to his promise made to Asaram, BJP leader and leading lawyer Subramanian Swami today moved a bail application in a trial court here and will be arguing for the release of the self-styled godman.Swami's assistants appeared in the court to submit the application. Judge Manoj Kumar Vyas allowed the application and has listed the matter for arguments on Tuesday."Swami himself will be coming on May 26 to argue on the bail application," said an assistant advocate, who appeared in the court with the application. Prominent lawyers of the country like Ram Jethmalani and Salman Khurshid apart from many other ace advocates have pleaded hard to get bail for Asaram but in vain. In August 2013, the 16-year-old inmate of Asaram's Chhindwara ashram in Madhya Pradesh had accused him of sexually assaulting her at a farmhouse in Jodhpur on the pretext of treating her. The girl's parents were allegedly advised by the warden of self-styled godman to take her to the Asaram to rid her off evil spirits.

Noted lawyer Subramanian Swamy on Tuesday failed to appear before a local court here for the third time to argue for the bail application of imprisoned Asaram Bapu in connection with a case of sexual exploitation of a teenaged girl. The trial court now set June 16 as the new date for the hearing on the sixth bail application in any court by Asaram, who is lodged in Jodhpur jail for one-and-a-half year. Swamy, a BJP leader, had moved a bail application in the trial court on May 23 and the court had listed the matter for May 26. But Swamy did not appear in the court for arguments on his bail application on that day and the court then posted the matter for June 2, said P C Solanki, counsel for the victim girl. Swamy did not turn up on June 2 either, after which the court listed the matter for today. Asaram’s counsel did not appear in the court today either for the “reason best known to him” and the court has posted the hearing for June 16, said Solanki. When asked about Swamy’s absence, Asaram said, “He is a nice man and would definitely come. Nobody should question his integrity.” This is the sixth bail application by Asaram in any court. Before this, five bail applications, two each in the trial court and the High Court and one in the Supreme Court have been rejected. —PTI

Who is advocate PC Solanki? Poonam Chand Solanki is a lawyer in Rajasthan’s Jodhpur. He was born to a former railway mechanic and is the only brother of three sisters. His family ensured that despite modest means, Solanki completed his education and eventually studied law. The lawyer joined the bar in 1996. His first high-profile came in 2002 as per an Asian Age article. He filed a PIL in the Rajasthan High Court against the immersion of Ganesh idols made of Plaster of Paris in Gulab Sagar near the historic Ghantaghar, as it led to the death of several fish in the lake. In 2014, he was approached by the parents of a minor who was fighting a rape case against prominent godman Asaram Bapu, which is how he came to be associated with the case. What was the Asaram Bapu rape case? Self-proclaimed godman Asaram Bapu (born Asumal Sirumalani Harpalani) ran over 400 ashrams in India and abroad as well as 40 schools. In August 2013, 1 16-year-old girl staying at Asaram’s ashram near Jodhpur, accused him of sexually assaulting her at the ashram on the pretext of ‘exorcising evil spirits’ out of her. The girl’s parents were disciples of Asaram and filed a zero FIR in Delhi. Asaram was arrested in September and imprisoned in Jodhpur, where the trial began in the sessions court. A saram was charged under Sections 342, 376, 506 and 509 of the IPC, as well as under Section 8 of the Protection of Children from Sexual Offences Act (POCSO) and sections 23 and 26 of the Juvenile Justice Act. "Bail is a fundamental right of Asaram and he would soon file a bail application in the lower court," Swamy said, adding that he would fight his case in the court. Comparing Asaram's case with those of politicians like Lalu Prasad and Jayalalithaa, Swamy asked, "when they could be out of jail despite being convicted, why could Asaram not be out of jail". Earlier, at the court, Asaram expressed hope regarding the meeting, saying, "Swamy would do something in my case."
