Chandrachud, The Hon’ble Chief Justice, Supreme Court of India. • We are writing this letter as People’s Union for Civil Liberties (PUCL) to bring to your attention the alarming rise of hate speech, vigilantism, and targeted communal violence against the minority Muslim community in Uttarakhand in the last few days. • We are a civil liberties and human rights organisation formed in 1976 by Sh. Jayaprakash Narayan, Acharya Kriplani, Krishna Kant and others. Justice V.M. Tarkunde, Justice Rajindar Sachar, Rajni Kothari, K.G. Kannabiran and other legal luminaries. PUCL has been at the forefront of the defence of the freedom of speech and expression in its work ever since its inception. However, as per human rights standards both internationally as well as in the Indian Constitution, the freedom of speech and expression does not extend to the ‘advocacy of religious hatred that constitutes incitement to discrimination, hostility or violence’ as per Article 19 of the International Covenant on Civil and Political Rights. Article 19 (2) envisages a restriction of the freedom of speech and expression on the ground of ‘incitement of an offence’. The sanctioned strength of the number of judges in the Apex Court is 34. Currently, the Supreme Court is functioning with 27 judges, including the Chief Justice of India. The five appointed judges are namely -- Justice Pankaj Mithal, Chief Justice of Rajasthan High Court, Justice Sanjay Karol, Chief Justice of Patna High Court, Justice PV Sanjay Kumar, Chief Justice of Manipur High Court, Justice Ahsanuddin Amanullah, a judge at Patna High Court and Justice Manoj Misra, a judge at Allahabad High Court. In a statement released by the IOA, they emphasized the importance of conducting the WFI Executive Committee elections and expressed their satisfaction in appointing Justice Mahesh Mittal Kumar as the returning officer. He, together with thirty other judges, presides over India’s Supreme Court. The CJI is chosen as a Judge of the Supreme Court and subsequently recommended for the position of Chief Justice of India by the retiring CJI, as per Article 124 of the Indian Constitution. The List of Chief Justices of India (1950-2023) is included in this article, along with their terms of office.
