Supreme Court extends interim bail granted to Zubair in UP FIR

The Supreme Court on Tuesday extended the interim bail granted to Alt News co-founder Mohammad Zubair by the top court in the case registered against him at Sitapur in Uttar Pradesh. A bench comprising Justices D.Y. Chandrachud and A.S. Bopanna listed the matter for final disposal on September 7. The bench noted that the state government seeks time to file a counter affidavit and allowed the government to file a reply within four weeks and rejoinder within two weeks thereafter. "Interim bail in Sitapur FIR case shall continue till further orders. List for final disposal on September 7, 2022," said the bench. The top court's order came on a plea by Zubair seeking quashing of the FIR registered against him at Sitapur. On July 8, the Supreme Court granted an interim bail for five days to Zubair in connection with a case registered against him by the Uttar Pradesh Police for a tweet, where he allegedly called Hindu seers 'hatemongers'. Supreme Court on Friday granted interim bail to Alt News' co-founder Mohammad Zubair in the case registered against him in Sitapur, Uttar Pradesh for allegedly outraging religious feelings. The apex court also issued notice to the Uttar Pradesh police on Zubair's plea challenging the Allahabad High Court order.

Granting relief to the journalist, Additional Sessions Judge Devender Kumar Jangala said Indian democracy and the political parties are open for their criticism and that merely criticism of any political parties is no ground to invoke section 153A (promoting enmity between different groups) and 295A (outraging religious feelings) of the Indian Penal Code(IPC). "Undoubtedly free speech is the proper foundation of a democratic society." The court further said the Hindu religion is one of the oldest religion and most tolerant and that followers of the Hindu religion are also tolerant. Six separate FIRs have been lodged against Zubair in Sitapur, Lakhimpur Kheri, Ghaziabad, Muzaffarnagar and Hathras districts in UP. Journalist and Alt News co-founder Mohammed Zubair has been granted interim bail by Supreme Court of India on Wednesday (July 20). The bail has been granted in all FIRs in Uttar Pradesh against him. The FIRs were filed for his alleged derogatory tweets. The court said that it found no reason or justification for deprivation of his liberty. The top Indian court said that "the existence of the power of arrest must be distinguished from the exercise of arrest and the exercise of the power of arrest must be pursued sparingly." "Having found from the record that the petitioner has been subjected to a fairly sustained investigation by the Delhi police, we find no reason or justification for the deprivation of the liberty of the petitioner to persist any further. Consequently, we are of the view that the petitioner shall be released on interim bail in each of the FIRs which form the subject matter of these proceedings under Article 32 of the Constitution", it said.
