By Divyesh Singh: Jailed gangster Gawli, in his writ petition filed at Bombay HC, has cited a 2006 circular of Maharashtra Home department which states that convicts who have served imprisonment for 14 years and have attained the age of 65 can be released from prison. He has stated that he has attained the age of 70 and has been in prison since May 2008. The 2006 Maharashtra government circular mentioned that, as per government notification dated January 20, 2006, he is entitled to be released after completion of 14 years of imprisonment. An incarcerated gangster-turned politician is 65 years old and is suffering from health issues due to his old age. The writ petition also mentions a 2015 circular of the Maharashtra government which states that the convicts booked under the Maharashtra Control of Organised Crime Act (MCOCA) are not entitled and are exempted from the 2006 notification. Arun Gawli has challenged the retrospective applicability of sub-rule(4) of Rule-6 of the Maharashtra Prisons (Review of Sentences) Rules, 1972, added vide notification dated December 1, 2015 by which Rule 6 was amended to take away the benefit of notification dated January 20, 2006 to persons who have been convicted under MCOCA Act. Known as the “Daddy” who ruled Dagdi Chawl, a slum in the heart of teeming Mumbai once home to many of the city’s blue-collar mill workers, Gawli was one of the most feared gangsters in India’s “Maximum City.” The son of migrants from central India who traded life in rural Madhya Pradesh for metropolitan Mumbai, Gawli dropped out of primary school to work as a milkman so that he could support his impoverished family in the big city.
