Full v. Limited IAEA Authority in California Probate Cases

There are two types of authority your attorney can ask for in your probate case under the California Independent Administration of Estates Act (“IAEA”). Which is better for YOU? I look at each case individually and make the decision that makes the most sense for you the client. There are counter-balancing issues on each side and we want to come up with the best decision in each case. Full IAEA is almost mandatory in some cases and is unnecessary in others. UPDATE: I am updating this post in June of 2020. We had three months of Court closures, limited to no court staff, some courts not processing filings, and most courts now allowing Zoom appearances. This all because of the Covid crisis. Now more than ever you can’t afford limited IAEA in any case where you want to sell real estate. Do not do it! IAEA full form

IAEA stands for the International Atomic Energy Agency. It is an international organization that seeks to promote the safe and peaceful use of nuclear energy and to prevents it from being used for military purposes. It was established on 29 July 1957 and has its headquarters in Vienna, Austria. It is currently headed by Director General Yukiya Amano. The programs and plans of the IAEA encourage and promote the peaceful use of nuclear energy, provide international safeguards against its misuse and promotes safety for activities which include nuclear reactions. To summarise, the main missions of IAEA are to promote the peaceful use of nuclear energy and higher standards of nuclear safety. It does not come directly under the control of the UN but reports to both the UN and the Security Council. The IAEA together with its former Director General Mohamed ElBaradei was awarded the Nobel Prize in the year 2005.

International Nuclear and Radiological Event Scale (INES)

Scope INES covers events at facilities and activities involving radiation sources. It is used for the rating of events that result in a release of radioactive material into the environment and in the radiation exposure of workers and the public. It is also used for events that have no actual consequences but where the measures put in place to prevent them did not function as intended. The scale is also applied to events involving the loss or theft of radioactive sources and the discovery of uncontrolled radioactive sources in scrap metal. INES should not be used to rate events resulting from procedures where people are intentionally exposed to radiation as part of a medical treatment. INES is intended for use in non-military applications and only relates to the safety aspects of an event. INES should not be used to assessing or comparing safety performance between facilities, organizations or countries. It also should not be used to trigger emergency response actions. Member States use INES to provide a numerical rating that indicates the significance of nuclear or radiological events. • Events are rated at seven levels.
