New Delhi: The Supreme Court today said that the Maharashtra Governor was not justified in calling upon then Chief Minister Uddhav Thackeray to prove majority in the Assembly on June 30 last year but refused to order status quo ante, saying he did not face the floor test and resigned. In a unanimous verdict on a batch of pleas related to the political crisis that led to the fall of the Maha Vikas Aghadi (MVA) government led by Uddhav Thackeray following a revolt by the Eknath Shinde faction, a five-judge Constitution bench headed by Chief Justice DY Chandrachud held that House speaker's decision to appoint Bharat Gogawale of the Shinde faction as the whip of Shiv Sena was "illegal". It, however, said since Mr Thackeray had resigned without facing the floor test, the governor was justified in inviting Mr Shinde to form government at the behest of the BJP which was the largest political party in the house. The war of words between the two alliance partners in Maharashtra broke out after Shrikant Shinde hit out at BJP local leaders accusing them of engaging in selfish politics. From 'bow and arrow' to 'mashaal'

Senior politician Chhagan Bhujbal, who was then in the Shiv Sena, had won the election from Mazgaon constituency in Mumbai on the 'flaming torch' symbol when the organisation did not have a fixed poll symbol. Bhujbal later rebelled and quit the party to join the Congress and is now a prominent leader of the Sharad Pawar-led Nationalist Congress Party (NCP). The 'flaming torch' symbol was used by the Sena in the past during civic body and Assembly polls. The Shiv Sena was founded by Bal Thackeray in 1966 and it took 23 years for the party to get the dedicated 'bow and arrow' symbol. The Sena was recognised as the state party in 1989, which meant it could use a uniform symbol in the state. But earlier, from 1966 to 1989, it contested on different symbols in the Lok Sabha, Assembly and civic polls.
