Understanding the Concept of the New Gratuity Policy of 2022

As per the Act of the Payment of Gratuity of 1972, gratuity is the amount of money that a worker earns from his employer. An employer may pay a gratuity to an employee as a thank you for his service to the firm. Gratuity is one of the components that an employee's gross remuneration includes. However, an employee is only entitled to gratuity payments after 5 years of service with the company. The Payment Gratuity Act of 1972 Every year of service entitles an employee to 15 days' wages as a gratuity. As part of the gratuity for each year of service, the company must pay a sum equal to 15 days of the employee's most recent wage. Salary in this context refers to the total basic earnings and dearness allowance. Furthermore, an employee receiving gratuity payments of up to Rs. 20 lakhs is exempt from paying tax on the amount received as part of the gratuity. After the new wage code is implemented, some employees are expected to see their salaries being restructured; companies are required to pay atleast 50% of the salary as basic wage. In cases where the basic pay is below the required mark, the employers may have to restructure the salary to comply with the new rules under the four labour codes, namely the Industrial Relations Code, Code on Occupational Safety, Health and Working Conditions Code, Social Security Code and Code on Wages. A new labor law, which is set to come into force in the UAE from February 2, 2022, will ensure that public and private sector labor practices and services are broadly aligned, a senior official said.
