Old Pension Scheme To All CAPF Personnel: दिल्ली हाईकोर्ट ने एक अहम फैसला सुनाया है. सभी CAPF (Central Armed Police Forces) के जवानों को पुरानी पेंशन योजना का लाभ (Benefits Of Old Pension Scheme) मिलेगा. दिल्ली हाईकोर्ट ने इस बारे में केंद्र सरकार को 8 हफ्तों के भीतर निर्देश भी जारी करने के लिए कहा है. जस्टिस सुरेश कुमार कैट और जस्टिस नीना बंसल की बेंच ने सभी याचिकाओं को खारिज करते हुए यह फैसला सुनाया है. दिल्ली हाईकोर्ट ने अपने फैसले में कहा कि सीसीएस (पेंशन) नियम, 1972 के अनुसार ओल्ड पेंशन योजना का लाभ CRPF, BSF, CISF और ITBP के सभी कर्मचारियों को दिया जाएगा. कोर्ट ने अपने आदेश में आगे कहा कि 22 दिसंबर 2013 को जारी किए गए अधिसूचना के मुताबिक सभी आर्म फोर्स को छोड़कर सेंट्रल गर्वमेंट के अन्य कर्मचारियों को नई पेंशन योजना का लाभ मिलेगा. ओल्ड पेंशन योजना को लेकर कोर्ट ने क्या कहा दिल्ली हाईकोर्ट ने अपने आदेश में कहा कि ओल्ड पेंशन योजना आर्म फोर्स के लिए पहले से ही मौजूद है. ऐसे में नई पेंशन योजना को लागू नहीं किया गया है. कोर्ट ने यह भी जानकारी दी कि नई पेंशन योजना के नोटिफिकेशन में यही जानकारी दी है कि नई पेंशन योजना आर्म फोर्स के लिए नहीं है. इसका मतलब है कि पुरानी पेंशन योजना का लाभ सीएपीएफ कर्मियों को मिलता रहेगा. गृह मंत्रालय के अधीन है आर्म फोर्स दिल्ली हाईकोर्ट ने सुप्रीम कोर्ट के एक फैसले का हवाला देते हुए कहा कि केंद्र शासित प्रदेश मिजोरम, (1981) जो दर्शाता है कि सीआरपीएफ सशस्त्र बलों का एक हिस्सा है. इसके आगे कोर्ट ने कहा कि गर्वमेंट ऑफ इंडिया के गृह मंत्रालय की ओर से 6 अगस्त को जारी किए गए एक सर्कुलर में कहा था कि सेंट्रल फोर्स मिनिस्ट्री ऑफ होम अफेयर्स के तहत आत...

In a landmark judgment on Wednesday, a bench of justices Suresh Kait and Neena Krishna Bansal, said that Article 246 of Constitution of India envisages that Armed Forces of the Union of India include “Naval, Military and Air Forces; (and) any other armed forces of the Union”, and hence, CAPF personnel deserve to get the benefit of Old Pension Scheme (OPS) . The court said held the CAPFs will not be covered under the New Pension Scheme as mentioned in the home ministry’s notification of December 22, 2003, and directed the Centre to issue necessary orders within eight weeks. According to the December notification, the New Contributory Pension Scheme (NPS) was implemented with effect from January 1, 2004 even though it had excluded the armed forces. It had, however, clarified that the NPS would be mandatory for all new recruits to the central Government service from 1st of January 2004. The Delhi High Court has ordered implementation of the Old Pension Scheme for all personnel of the Central Armed Police Forces (CAPF) and directed the Centre to issue necessary instructions within eight weeks. The high court quashed a 2003 notification of the Ministry of Finance and a 2020 Office Memorandum (OM) of the Department of Pension and Pensioner's Welfare to the extent that they deny the benefit of the Old Pension Scheme (OPS) to the personnel of central paramilitary forces who were appointed pursuant to January 1, 2004 advertisements. The petitions were filed by personnel of the Central Reserve Police Force (CRPF), Sashastra Seema Bal (SSB), Border Security Force (BSF), Central Industrial Security Force (CISF) and Indo Tibetan Border Police (ITBP). “It is made clear that the notification dated December 22, 2003 as well as OM dated February 17, 2020 granting the benefit of OPS shall be applicable in rem (directed against a thing). Meaning thereby, OPS shall not only be applicable in the case of petitioners herein but all the personnel of CAPFs at large. Pension System for Retired CAPF Personnel There are demands from the in service and retired Central Armed Police Forces (CAPFs) and Assam Rifles (AR) personnel for extending One Rank One Pension (OROP). CAPF & AR personnel retire only on attaining the age of 57/60 years and they are entitled for pension and other pensionary benefits as per Central Civil Services (Pension) Rules, 1972. These rules are different from the pension rules applicable to Ex-Servicemen. Further CAPF & AR personnel, who are appointed on or after 01/01/2004 are covered under New Pension System (NPS). The Government has taken several steps for the Central Armed Police Forces (CAPFs) personnel including Next of Kin (NoK) of CAPFs personnel who lay down their lives for the country. Following benefits, inter alia, are given to Central Armed Police Forces (CAPFs) personnel including the Next of Kin (NoK) of those who lay down their lives for the country:- (i) Ex-gratia lump-sum compensation @ Rs.35 lacs for death on active duty and @Rs. 25 lakhs for death on duty, as the case may be, is entitled to the Next of Kin of the deceased personnel.
