Several housing societies in Mumbai are on the verge of undergoing redevelopment or they are in the final stages of confirming the same. Acquisition of conveyance or deemed conveyance is critical to get to the redevelopment stage. Here is what the model Society Bye – Laws state about that: Society Bye – Law No. 174 • Redevelopments of the Property / Building of the Society including vacant spaces shall be done strictly in accordance and confirmation with the Directions issued by the Government of Maharashtra vide Government Resolution no. CHS 2007/M.No. 554/14-S dated 03 January 2009, under section 79 of the Maharashtra Cooperative Societies Act 1960 (as amended from time to time). • If the development Agreement is not executed with the developer in that case, the Society after cancelling the same resolution, the Society may appoint a new developer from the short list of approved developer, and if it is not possible, fresh procedure can be initiated. Pune: Members of around 1,000 cooperative housing societies in the city that are more than 30 years old are waiting for the implementation of the single-window system announced in September 2019 for clearance of self-redevelopment projects. Under self-redevelopment, residents of the society shoulder the onus of construction by appointing a developer and ensuring control over the project. Recently, a society in Sahakarnagar had to wait for over a year to get the necessary clearances for self-redevelopment. This is the reason why many other societies have adopted a wait and watch policy, said state housing federation members. Suhas Patwardhan, vice-president, Maharashtra State Housing Federation, said that a meeting with the chief minister and deputy chief minister was scheduled before the assembly session, but it did not take place. “While the state has over 45,000 eligible housing societies that can go for redevelopment, a single-window system proposed in September 2019 policy would have helped,” he said. Of the 1.2 lakh registered cooperative housing societies and apartments in the state, nearly 45,000 are over 30 years old and eligible for redevelopment. In January, deputy chief minister Devendra Fadnavis had told TOI that the state government was planning to restart the single-window system and implement the 2019 order. New housing society rules may be out by March

PUNE: Housing societies in the state can expect the new Maharashtra Cooperative Housing Society rules by the end of March. These rules are expected to speed up pending redevelopment proposals of old housing societies as well as ensure clarity regarding membership issues for the smooth functioning of these societies. State housing federation members who were part of several rounds of discussions with the state cooperation department recently confirmed this development. The Maharashtra Cooperative Housing Societies Act (Amended) was introduced in March 2019. However, the rules that were to be introduced within six months were delayed due to the Covid-19 pandemic. The framing of rules was essential to implement the Act, said advocate Shreeprasad Parab, who represented the state housing federation in the discussions. While these may be the main benefits, there are several other provisions that will be included in the rules once it is published by the state government, he added. "The last meeting held in the presence of cooperation department officials and members of the federation had agreed that the rules will be published earliest by March 2023 and this will help all these societies as has been demanded by state housing federation since the last four years," said Parab, the expert director of Maharashtra State Housing Federation. The aim of the studio was to develop a housing project for a brownfield or greenfield site in the city of Ahmedabad, Gujarat. The brownfield site of Gujarat Housing Board Society located in Naranpura in the west zone of the city, was selected for the Public Housing Redevelopment Project. The land potential analysis, legal aspects of the site, macro market, micro market analysis and beneficiary needs were studied in detail for the project development. The project is proposed as per the needs of the existing residents of the society with adherence to applicable policy and the demand for real estate market trends. The redevelopment of public housing along with development of free sale component with mixed development, is a viable and implementable project proposal ensuring benefits to the beneficiaries, new buyers and profit to both developer as well as Gujarat Housing Board. A conveyance deed is a vital legal document that transfers the ownership of land to a cooperative housing society from a developer or from the previous landowner. In several cities like Mumbai, many housing societies face the challenge of obtaining the conveyance of land. The major problem arises during the redevelopment of societies having old and dilapidated structures. Consequently, the Maharashtra government introduced the concept of deemed conveyance in 2008, and published the rules pertaining to it in 2010. Under deemed conveyance, a society that did not receive the conveyance was entitled to apply to the Deputy District Registrar (DDR) of Cooperative Societies that would pass an order conveying the land in favour of the society, after verification of the documents submitted and upon hearing both, the society and the developer.
