Satellite Communications: Regulatory, Legal, and Trade Issues

This chapter focuses on the regulatory, legal, and trade issues related to satellite communications. The chapter first examines the regulatory and legal issues on three levels: the global or international arena, regional regulatory institutions, and national regulatory frameworks. Next, the chapter focuses on a discussion on the role of satellite communications in global trade and will review the regulatory, legal, and trade issues of satellite communications on the global scale. The last part will discuss issues related to the settlement of disputes that may arise from satellite communications, as well as the legal principles of responsibility and liability for any damage caused by satellite communications. Note that this chapter does not deal with the legal and other issues related to the International Telecommunications Union and radio frequencies, which have been dealt with in previous chapters of this book. This resource has a dual “orbit/spectrum” nature because its value can only be realized through the simultaneous exploitation of both the geostationary orbit and the electromagnetic spectrum. The geostationary orbit, a ring of space six earth radii above the equator, is where a communications satellite must be placed in order to assume a fixed position in the sky.
